Yesterday, we told you that Luis and Rocio Garcia had taken an interesting new direction in their federal fraud lawsuit against Scientology. After spending a few months gathering evidence about several Scientology entities, they decided to drop three Scientology trusts as defendants, and then requested the right to amend their original complaint.
They filed that request on Wednesday, just one day before Scientology was due to make its own filing to support its motion to dismiss the lawsuit on jurisdictional grounds.
We have Scientology’s filing, below. It’s no surprise that Scientology is complaining about the way the Garcias filed their brief just the day before. Naturally, the church reiterates its position — that the jurisdiction problem is fatal to the entire lawsuit which should be dismissed.
Our legal experts tell us they’re having a hard time handicapping this one. Judge James Whittemore might go either way, they tell us, and either dismiss the suit entirely or allow the Garcias to amend their complaint and essentially start over.
But there’s more that interests us here. Scientology went ahead and filed a ton of supporting evidence to prove a point that, after the Garcia filing, might be moot. They have submitted a ton of information about the various trusts and entities which our obsessive document-hungry readers may enjoy. So we’ve loaded all of them to our Scribd account, and we hope you have a fun time going through them.
First, here’s Scientology’s memo in support of its memo…
