For instance there were some (not all in fact I ran into quite a few who were and are spooks who think OT is a very cool thing) in CIA and other sectors of ‘National Security’ who feel threatened by it. I mean their job is to keep things secret and hidden and having pesky OTs around totally ruins that game plan for ’em. Then of course you have your average SP who isn’t too thrilled by the idea because it makes ‘the masses’ (probably an appropriate term by those stuck in a GPM) harder to suppress and dominate.”

1996: The UN Human Rights Committee criticized Germany this week, alleging discrimination against Scientologists. From AFP:
“The 18-member committee discussed Monday and Tuesday the first report on the human rights situation in Germany to be submitted by Bonn under the terms of the 1976 International Covenant on Civil and Political Rights since the country was reunified in 1990. A senior official of the German justice ministry, Matthias Weckerling, defended moves against the controversial Church of Scientology as prompted by the duty of the state to protect its citizens against the activities of certain religious sects. But members of the committee said there was a very fine line between protecting the public and respecting the rights of religious expression and belief.”

“The United States is having an awful happy time right now pouring billions into foreign aid so these dirty, filthy, fly-ridden grass huts in Balooga-uga-uga-stan can all be torn down and they can put in nice seven-bedroom ranch houses with hot and cold running politicians throughout. And they’re just having a ball. And nobody is more surprised or will be more surprised than the United States government at the end of a period of time to find out that the exact proportion of ‘hate the United States government’ and ‘love the United States government’ exists as before. They might even have gone over toward ‘hate it’ before, to the degree that they actually enforced people to live in these seven-bedroom ranch houses, see. Because you talk to a boy in Blooga-uga-uga-uga-stan and he’s liable to tell you something on this order: ‘Ah, nice house, yeah, nice house. Yeah, reeds, reeds, nice reeds, side of a river, nice reeds. “More and more, it’s becoming apparent that the whole thing is being held together by a miniscule army of hard core true believers who are desperately trying to keep the roof from caving in on them. The orgs are empty. There are no new customers. Existing customers are slipping away in the night, and those who remain have been bled completely dry. Meanwhile, the news media is reporting on all the church’s dirty laundry – driving the church’s already wobbly public relations to unprecedented lows. The thing is now feeding on itself and shrinking by the day. At some point, only the Sea Org will be left – manning empty mausoleums and listening to pins drop.”

1997: A progress report was posted this week on the Lisa McPherson civil case. “In depositions with (aunt) Dell Liebrich and (friend) Kelly Davis, Scientology is preparing the case that Lisa had a terrible childhood and abusive family. They also demanded to know who was paying for the lawsuit, perhaps to set up the theory that this is being financed by enemies of Scientology. In a deposition of Robert Davis, the Associate Medical Examiner who conducted the autopsy of Lisa, he at first claimed that he used the terms ‘insect bite’ ‘abrasion’ and ‘contusion’ interchangeably. But when confronted with the autopsy photos, was able to point out the clearly visible insect bites on her knuckles, and said the marks on her wrists are consistent with restraint. They may have come from any number of circumstances, but that restraint would make marks like that. The ME’s office continues to disagree, saying that there are no ‘edge’ features that would be typical of restraint. There are apparently other portions of the deposition in which he contradicts the ME’s office in the 300 page deposition. Although he claimed that Scientology did not approach him beforehand, sources say that he was approached, perhaps in an attempt to influence his testimony. There will be a hearing in Tampa on July 1st, in which Ken Dandar will ask the judge to release Scientology’s records of Lisa’s treatment at the Fort Harrison from the confidentiality provision. Apparently Scientology took extensive notes while she died.”

“I can take a look at my desk barometer any day of the week and get a better weather forecast than I get over the telephone. I’m being hard on the boys. Every year they get a little bit better. They’re finding the sky too. And then all of a sudden we get into passenger traffic left and right across the Atlantic, and we hear ‘above-the-weather flight,’ ‘radar-spotted weather,’ you see, and so on. They’re still finding clouds. They haven’t found the sky yet, see. Then they shot off a few cosmonauts, who became naught in Russia with great rapidity, and they found a great deal there called ‘the sky.’ And five dead cosmonauts later, the Russians must have decided that they should know something about it. But because they had lots of cosmonauts they probably haven’t bothered. But the point is, they send people up into the Van Allen belt, named after Van Allen. Who the hell heard of him? I don’t know, maybe he was the fellow who invented radiation fallout or something. In other words, they shoot people up into these areas, and they get scorched or something happens or something of that sort, and they’re in the big vagueness of ‘There is a sky.’ They’re still on this thing here, see.” — L. “Captain Mary Sue Hubbard has just returned from correcting and bringing off a mission flubbed by three others. She, accompanied by Liz Ausley, did in 3 days what has been hanging fire for nearly 3 weeks. 1997: Grady Ward reported this week that Scientology has stepped up efforts to discredit him, this time with Dead Agent packs sent to his home town of Arcata, California. “I was was informed by Rusty Stoob that the scientologists have launched an ad hominem attack upon me and my children, Adrian and Isaiah, over the internet, purportedly from one ‘Michelle Janney’ of El Segundo, California. Dated May 25, 1997 with a return address of ‘mjanney@mac-mail1.interworld.net’ the letter accuses me of writing ‘pornography’ and suggests that I am a danger to my children. A neighbor whose daughter attend Pacific Union had the pleasure of seeing the Arcata Police Department escort a private investigator who was ‘staking’ out our Vassaide neighborhood a few weeks ago. I have just learned that the same ‘Michelle Janney’ has used the U.S. Mails to send what she describes as ‘pornography’ unsolicited to a mailing list of Arcata homes and businesses. I will be making an ex parte motion for a temporary restraining order Monday and of course I will immediately contact the Postal Inspector and the US Attorney’s office.”

Danny Masterson victims calmly answer Scientology’s latest whine in lawsuit

On Wednesday, a hearing is scheduled in the Bixler v. Scientology lawsuit, the one filed by Danny Masterson’s victims against the imprisoned Scientology celebrity and against the church itself.

This lawsuit was originally filed in 2019, before Masterson was charged criminally in 2020, and it was originally about the harassment these women say they’ve been through since coming forward to the LAPD in 2016, and not about the sexual assaults themselves.

But since Masterson was put away last year and a stay was lifted on the Bixler lawsuit, the women are attempting to bolster it with allegations of sexual battery, they want to bring in an additional plaintiff (actress Tricia Vessey), and they want to add racketeering allegations and prove that Scientology itself is a criminal enterprise.

We told you that Scientology, not surprisingly, is opposed to allowing a new amended complaint with all of those additional allegations. In particular, Scientology pointed to the fact that Judge Upinder Kalra has yet to rule on the church’s anti-SLAPP motions and their attempt to gut the lawsuit. Without that ruling, they argued, the Jane Does should not be allowed to amend the lawsuit.

Now, with a few days to go before the hearing, the Jane Does have answered that with a reply from Simon Leen, one of their attorneys, that says Scientology is making arguments that aren’t backed up by case law.

In fact, Leen points out, previous cases are on their side: While Judge Kalra is still making up his mind about Scientology’s attempt to anti-SLAPP some of their allegations, there’s nothing preventing the court from allowing in new allegations that have nothing to do with the ones he’s mulling over. And in fact, Leen says, if Scientology doesn’t like the new allegations, they can always file additional anti-SLAPP motions to try to get them removed. (And knowing Scientology, they probably will.)

As for Scientology’s whining in their opposition that the court shouldn’t allow amendments to a lawsuit that was filed almost five years ago, Leen points out the obvious: There was a pandemic that slowed down litigation, there was a years-long stay on the case as the Masterson’s criminal case went through two trials, and in all that time new allegations became known to them which should be allowed in the lawsuit.

Plaintiffs have sought leave to amend shortly after the case was unstayed, while the parties are in the very initial stages of discovery (which remains stayed
due to Defendants’ anti-SLAPP motions), and with approximately two years remaining before trial. Under these circumstances, courts routinely grant motions to amend.

So once again, Scientology’s gnashing of teeth is answered by what appears to be a pretty calm recitation of logic. Will the judge see it that way?

As we said before, Judge Kalra has a lot to decide in this case, and on Wednesday we are interested to find out which way he’s leaning.

1996: An article from the St. Petersburg Times detailed the cult’s request for changes in Clearwater’s housing regulations. The cult wants to pack in twice as many Sea Org members into the Hacienda Gardens, the barracks for low ranking SO and many RPF. “The change would cut in half the required living space and eventually provide homes for the 300 new Scientology staff members needed for the ‘Super Power’ facility, said Richard Haworth, a spokesman for Scientology’s Clearwater-based Flag Service Organization. Hacienda Gardens, 551 N Saturn Ave., has 200 units populated, in large part, by members of Scientology’s Sea Organization, who wear Navy-style uniforms and sign billion-year contracts to devote themselves to Scientology. Sea Org members, as they are called, spend 10 to 14 hours on the job daily. That unusual work schedule, and the fact that they eat their meals at Scientology dining halls and not at home, means that the city’s normal living standards aren’t necessary in Hacienda Gardens, Haworth said. ‘The units are used primarily for sleeping and are seldom used for cooking, entertaining, etc.,’ the Scientology request said. ‘If this variance is not granted, then, among other results, the applicant will be required to acquire additional property for housing purposes, which property will then be removed from the tax rolls.’ The Scientology request asks that in 120 apartments, the city’s minimum dwelling space requirements be cut in half. For a 700-square-foot apartment, for instance, the change would boost the number of Scientologists allowed from six to 13. In April 1992, city building officials cited the church for overcrowding in 34 of the Hacienda Gardens apartments. Scientology officials moved staff members around to alleviate the overcrowding, which they blamed on the logistics of renovating the facility.”

While Scientology tries to derail Danny Masterson victims, here’s more detail from them

This week Scientology is attempting to deal a blow to the Bixler v. Scientology lawsuit, which is the one filed by Danny Masterson’s victims in 2019. They have fought back against Scientology’s attack by posting more details of the harassment they’ve been going through since they came forward to the LAPD in 2016. They’re suing Scientology, its leader David Miscavige, and Danny Masterson for being behind years of harassment of these women.

We already showed you the stunning allegations of Jane Doe 1 and then Jane Doe 2.

Today, we have the declaration of Jane Doe 3, who is going by her actual name in the civil lawsuit.

Again, we ask you to imagine if this information were to be presented to a jury as we wait to see what Judge Upinder Kalra decides to do tomorrow with Scientology’s motion to strike.

DECLARATION OF CHRISSIE BIXLER

I, Chrissie Bixler, declare as follows:

1. I am over the age of eighteen (18). I have personal knowledge of the facts stated below and, if called upon to do so, could and would competently testify thereto.

2. I am a Plaintiff in the case of Bixler, et al. v. Church of Scientology International, Inc., et al.

3. I submit this Declaration in Support of Plaintiffs’ Opposition to Defendants’ Special Motion to Strike Certain Allegations and Corresponding Causes of Action from the First Amended Complaint of Plaintiffs Chrissie Bixler and Cedric Bixler-Zavala (“Motion”).

4. Plaintiff Cedric Bixler-Zavala and I were lawfully married on July 24, 2009, and remain married to the present day.

5. I met Defendant Masterson in or around 1996, and we began dating shortly thereafter. In or around 1997, I became involved in Scientology because of his insistence.

6. Throughout my relationship with Defendant Masterson, Masterson regularly forced me to have sex with him and became violent when I resisted. In or around late 2001 to early 2002, Masterson committed multiple acts of sexual violence and assault against me. On more than one occasion, I awoke in bed to find Masterson sexually assaulting me. In one specific instance, Masterson drugged my wine at dinner and anally raped and sexually assaulted me. The following morning, Masterson admitted to me that he repeatedly had anal sex with me while I was unconscious.

7. The next day, I reported Defendant Masterson’s actions to Corporate Defendants, through their head ethics officer, Miranda Pearson Scoggins (“Ms. Scoggins”). Ms. Scoggins listened to my account and told me that I was not to refer to the incident as “rape.” Ms. Scoggins assisted me in writing a report about what happened, but instead of a standard incident report, I was instructed to write a “Things That Shouldn’t Be” Report. In sum and substance, Ms. Scoggins told me that I was not raped by Masterson because “you can’t be raped by someone you are in a consensual relationship with.” Ms. Scoggins went on to interrogate me about what I did to cause the assault and ordered me to complete an ethics course.

8. The Corporate Defendants did not report the abuse to any governmental authorities, nor did they take any other action to protect women from future harm by Defendant Masterson. In the following years, I did not disclose to the authorities the sexual abuse and assault I suffered at the hands of Defendant Masterson.

9. In or around October 2016, I wrote letters to Brie Shaffer (Defendant Masterson’s personal assistant), Ellery Travers, Jenny Butler, and Susan Watson (President of Defendant CCI), formally terminating my relationship with Scientology and informing them that I was aware of the roles they played in my abuse and the subsequent efforts to silence me. I sent Defendant Masterson copies of these letters.

10. After sending the letters, Defendant Masterson’s publicist, Jenni Weinman, an agent of Masterson’s, contacted me. Initially, I refused to speak with Weinman, but eventually I agreed to talk after Weinman told me “things are about to get serious [for me and my family].” Weinman forwarded a letter from Defendant Masterson to me along with Weinman’s threat that things were about to get “serious.” The letter contained threatening, abusive, and harassing language and contained false and malicious claims about me that Masterson was prepared to release. The letter threatened the release of this false information unless my husband, Plaintiff Bixler-Zavala, and I took “a good look at what [we thought we] could gain” from speaking publicly and reporting to law enforcement Masterson’s sexual assaults.

11. In or around December 2016, I made a report to the LAPD about Defendant Masterson’s sexual assault and the LAPD opened a criminal investigation into Masterson.

12. Thereafter, as previously threatened, Defendants launched a campaign of harassment, surveillance, and abuse against me and my family which continues today.

Instances of Physical Surveillance and Harassment

13. As soon as it became public knowledge that the LAPD was investigating Defendant Masterson, Weinman issued a press release publicly naming me as the accuser, calling me a liar, and falsely claiming that I had threatened Masterson’s wife.

14. Since that time, and almost on a weekly basis, my husband and I have discovered our locked car doors and trunks to have been opened. Generally, on these occasions, nothing is stolen from our vehicles, although on one occasion our car insurance paperwork and registration was stolen.

15. Throughout 2017, on a persistent and regular basis, we observed Defendants’ agents loitering outside our home and looking into our windows. We also observed vans parking outside our home and filming our home and family.

16. In or around 2017, our neighbor informed us that individuals claiming to be affiliated with law enforcement told the neighbor that we were pedophiles that were abusing our children. After this, the neighbor became hostile and threatening towards my husband and I.

17. In or around October 2017, I was driving on the street where my home was located when I was chased by two of Defendants’ agents in a vehicle who were filming me. I was so frightened that I drove to the local police department. I reported this incident to law enforcement and was advised not to return home for the night.

18. When I returned to my home, I noticed that a pile of important mail was missing from the table I had left it on.

19. The following day, our family dog died inexplicably. After an autopsy, we learned that our dog died of unexplained traumatic injuries to her trachea and esophagus.

20. In or around November 2017, Defendants’ agents followed me into a nail salon and harassed and photographed me.

21. In another incident in or around November 2017, an individual filmed my husband and I from outside our home.

22. In a third incident in or around November 2017, a man in a luxury car with no license plate followed me and filmed me.

23. While living in Texas, the house behind our house was purchased. Individuals began to enter the house in what appeared to be shifts, with one group of people entering during the day and another group entering in the evening. We never saw anyone bring any normal furniture into the house (except for a dining room table) but did see people bringing electronic equipment into the house. Shortly after the house was purchased, I noticed that my phone’s geolocation was indicating that the phone was located at this house.

24. In or around January 2018, my husband and I and our family moved back to Los Angeles, California. Three days after moving into our new residence, we awoke to find all our car doors open.

25. About eight months after we moved back to Los Angeles, two individuals moved into the house behind our house. Shortly thereafter, although I had my phone with me at my home, I noticed that my phone’s geolocation tracker was indicating that the phone was located at the house into which the two individuals had moved. Fearing for our safety, we decided to move again. Despite not having told these two individuals that we intended to move, and prior to us putting our home on the market, these two individuals came to our home, made conversation with me, and asked me where I was moving.

26. In or around August 2018, I saw a man in a white truck parked outside of my home for several hours. During this time, I was experiencing technical issues with my cell phone. I approached the man and observed a computer, cell phone, and other devices set up inside his truck. The man and I got into a verbal altercation, and the man ultimately spat on me. I called the police and the man was later identified as Steve Miller, another of Defendants’ agents.

27. Steve Miller and his vehicle were later identified by Plaintiff Jane Doe #1 and others as the same person who had surveilled them in front of their homes. Miller was also identified by individuals who had seen Miller passing out Scientology pamphlets on Hollywood Boulevard in Los Angeles, California.

28. In or around August 2018, a neighbor told me that two individuals claiming to be LAPD Detectives requested footage from their home surveillance cameras showing our house. I asked the LAPD Detective who was investigating Defendant Masterson about the incident and was told that no Los Angeles Police Detective has requested any such footage.

29. In or around September and October 2018, Defendants’ agents broke the lock to our front door.

30. In or around March 2019, a vehicle followed me for over an hour. Eventually, I was able to determine that the driver of the vehicle was filming me.

31. In or around April 2019, Plaintiff Jane Doe #1 and I attended Denim Day, a sexual violence prevention event. When we arrived, we were immediately confronted by Defendants’ agents, including Scientologist Taryn Rinder-Teutsch, who harassed and filmed us.

32. In or around May 2019, my car tires were slashed.

33. In or around June 2019, I was run off the road by a vehicle that was following me.

34. In or around June of 2019, my husband and I and our family moved to a new home as a result of this constant surveillance and harassment. We specifically selected this residence as it is private and surrounded by government-owned property. No other homes were visible from inside our home at the time we moved in. After moving in, however, I observed two men on an adjacent property cutting down a large tree branch. Once this tree branch was removed, the inside of our home was visible to another property that was previously blocked by the branch.

35. In or around June 2019, a man followed me in a pharmacy. The man approached me and whispered to me “We see you.” I fled the pharmacy.

36. In or around July 2019, a woman contacted me claiming to be interested in artwork that I was selling. When the woman came to my residence to view the artwork, the woman did not appear interested in the artwork, and instead asked me a series of questions about my residence, the boundaries of my property, and the location of my bedroom in the residence. When I escorted the woman to the front gate to leave, the woman told me “I wouldn’t stay here alone if I were you.”

37. In or around July 2019, a different tree on our property was poisoned, which contributed to us again moving to avoid further harassment.

38. In or around July 2019, my husband and I observed a man loitering around our property and looking into windows for over two hours. Upon seeing the man outside, my husband stated “he’s OSA for sure.” Seemingly able to hear him, the man looked up immediately and smiled at us. The man left, only to return several hours later. When we saw him the second time, he smiled and waved.

39. In or around July 2019, a glass coffee table that we had placed outside was smashed while we were not at home.

40. In or around July 2019, I was home alone in bed when I heard a number of thumps originating from the walls of my home. Investigating in the morning, I found that a number of large stones had been thrown against the outer wall of my master bedroom.

41. In or around August 2019, a man followed me in my car while filming me.

42. Our trash has been regularly stolen since I went to the authorities in 2017. In or around December 2019, I saw two individuals stealing our trash and confronted them. They told me, “You don’t even know what you’re dealing with” and called me a “lying whore.”

43. On another occasion, I became aware of a vehicle following me and matching my speed to maintain pursuit. When I called the Assistant District Attorney prosecuting the criminal case against Defendant Masterson, he directed me to go to the nearest police station. When I approached a police kiosk, the vehicle broke off its pursuit of me.

44. In or around December of 2019 or January of 2020, I encountered two unknown men looking over the fence into our backyard. When I initiated a conversation with the two men, they continually commented that I “had nice dogs.”

45. In or around January 2020, we suffered yet another tragedy as a result of reporting the sexual assaults at the hands of Masterson and speaking out against the Defendants. We discovered an amount of ground meat had been thrown over our fence into our back yard. The meat had been packed around a rectangular tablet of rat poison. We soon learned that one of our dogs had consumed some of the raw meat and rat poison. The dog died as a result of ingesting the poison. In the days following the death of our dog, we also discovered ground meat in the area of our fence to our driveway. Packed within the ground meat was broken glass. This area is regularly used as an entrance and exit to our home.

46. In or around February 2020 Defendants and their agents trespassed onto our property in order to photograph the residence and anyone present on the property.

47. In or around April 2020, my husband and I found a small white envelope buried in the flower bed of our new home. The envelope contained a Valentine’s Day card that Defendant Masterson had written to me in 2002.

48. In or around June 2020, a man appearing to be a private investigator stood near our home for an extended period of time. During that time, my husband attempted to call me, but the call would not go through.

49. In or around July 2020, I saw a man slowly drive around our home and then park near our driveway. When I approached the car, the man immediately drove away. Shortly thereafter the same man, who had parked elsewhere, began walking up our driveway until I told the man to leave.

50. In or around August 2020, my husband and I found rotting fish just outside our house.

51. In or around December 2020, a car followed me for twenty minutes on my way to a car dealership. When I attempted to trade in my car as part of the process of purchasing a new car, I was informed that the car I was trading in had been fraudulently registered and was no longer registered to me.

52. In or around February 2021, a man followed me into the parking lot of a hardware store. Once I parked, the man walked up to my car and stared at me.

53. Also in or around February 2021, our external cameras at our home were disabled remotely or by other means, and the next morning I found a bag of candy on my front porch.

54. In or around December 2021, a vehicle followed my husband for over ten minutes, including down side-streets.

55. Over the course of approximately two weeks in or around January 2022, a man repeatedly knocked aggressively on our door. The man said that he was from the Census Bureau and asked me personal questions about me and my family. When I refused to answer his questions, the man acted in an aggressive manner and threatened to have me arrested for refusing to answer the questions. When I asked for identification showing that the man worked for the Census Bureau, the man refused to provide any identification.

56. In or around March 2022, my children reported a man dressed in all black standing by our car and staring at them. Neighbors confirmed seeing a man dressed in all black.

57. In or around April 2022, a man and woman followed me and my husband to an open house. The pair did not appear interested in the house and instead followed us around the home. After the open house, the couple followed me and my husband down a dead-end road.

58. In or around April 2022, our WiFi password was changed without our knowledge or consent. We called our internet provider to alert them to the situation. A man claiming to have been sent by the carrier arrived at approximately 9:00 p.m. that evening. When asked for his business card, the man said that it was against the carrier’s policy to carry business cards. The man began working on wires outside of our home until we asked him to leave. When my husband called our internet provider the next morning, the provider stated the company did not send employees out past 6:00 pm. My husband requested someone be sent to work on their WiFi and the service provider offered to send someone later that afternoon, which was several hours in the future. Approximately 30 minutes after the call ended the same man who had shown up the prior evening returned. Despite my requests that the man not work on the internet wiring, the man continued to do so and refused my requests for him to leave until my husband arrived and insisted that the man leave.

59. One night in or around May 2022 our external security cameras were deactivated. When we went outside, we saw our new car was gushing fluid. A mechanic later determined that the transmission was damaged despite the car having been driven for fewer than 5,000 miles.

60. Later in or around September 2022, one of my friends informed me that two individuals who identified themselves as LAPD detectives had called them asking for information about me. I later spoke with LAPD Detective Vargas, who was investigating Defendant Masterson, and Detective Vargas said neither he nor any other law enforcement officer that he knew had called my friend.

61. In or around November of 2022, Plaintiffs Riales, Jane Doe #2, and I were followed and filmed by private investigators while waiting for the verdict in the Defendant Masterson’s criminal trial.

62. In or around December of 2022, my husband took our children to a park. A man sat on a swing next to one of our children and then initiated a phone call where he described the children’s physical appearance and what they were wearing. A few days later my husband took our children to a different park and the same man arrived within minutes of their arrival.

63. In or around October 2023, after I left a doctor’s appointment, a man exited a car with no license plates, approached me and my children, and screamed at and threatened me and my children. When I reached my car, I found the doors unlocked, despite having locked the doors prior to going to the doctor’s appointment.

64. In or around October 2023, someone tampered with our drinking water at our home by breaking one of the five-gallon containers in which we kept our drinking water and unscrewing the cap on another container.

65. Since Defendants’ campaign of terror and harassment began, there have been three separate occasions where a “VACANT” sign was placed inside our mailbox and we would cease receiving mail. During one of these instances, I was expecting my driver’s license to be delivered, but it never arrived. I had to file a report with the DMV to get a replacement.

66. To this day, we continue to be threatened, harassed, stalked, and surveilled by Defendants and their agents.

Instances of Electronic and Online Harassment

67. Defendants have used numerous technological forms of harassment against my husband and I. Both of us have received repeated and harassing spam phone calls. I have received calls on my phone that appear to originate from my own phone number. We receive text alerts that are delayed by days, weeks, months, and even years. I have received emails originating from my own email account containing dangerous links I did not send. We were the victims of repeated email hacks that included the destruction of important emails in our accounts. Text messages and photos, often relating to the harassment suffered by my husband and I, were deleted from my phone, and my phone was “ported” such that calls, text messages, and other information were routed to a device that does not belong to me, and of which I am not in possession.

68. My phone periodically turns on without me turning it on, scrolls without me scrolling, and takes screen shots without me taking screen shots. I will sometimes hear a clicking sound on phone calls, which on one occasion stopped when I asked my interlocutor, “Do you hear that?” This clicking sound is consistent with a method of wiretapping known to be used by Scientology. I also sometimes hear unknown voices bleeding into my phone calls. My phone will sometimes be hot to the touch despite me not having used the phone recently. On several occasions, I have attempted to add an additional number to an ongoing conversation, but have been alerted by my phone that I could not do so because there was already a third line on the call (despite, to my knowledge, there not being a third line on the call).

69. We invested in a home security system and installed cameras. During the installation, the technician verbally supplied us with the password for the system. Within five minutes, the security system was hacked, and the password was changed. The installation technician, who was still present and observed the unsolicited change in password, had no explanation for how this could occur.

70. Over the course of four months, Defendants and their agents hacked and disabled our home security system multiple times.

71. Beginning in or around December 2017, Defendants or their agents repeatedly attempted to hack into my email and social media accounts. In multiple instances, Defendants were successful. On one occasion, all emails in my email account between me and Detective Myape (formerly Reyes) of the LAPD, who was investigating Masterson, were deleted. On another occasion, photos documenting the harassment I was suffering were remotely deleted from my phone.

72. In or around June of 2018, Defendants hacked into my Instagram account and attempted to change the password.

73. In or around August of 2018, Defendants’ agents Heather Seidler and Virginia Macgregor published posts to their Facebook accounts inciting fellow Scientologists to assist in harassing me. In one post, Macgregor stated that I was “reminiscing about all the anal sex [I] obviously miss.”

74. In or around August 2018, I received a message via Twitter in which the sender told me to keep one eye on the road; and the next day a vehicle attempted to run me off the road.

75. In or around September and October 2018, Defendants’ agent Kathy Gold started publicly threatening me and the other Plaintiffs, and their relatives. Gold accused me and the other Plaintiffs of being religious bigots and liars and threatened to commit serious and violent crimes against us, including murder. Gold threatened to report me to Child Services to have our then five-year-old twins taken away from us and further threatened that the children would be drugged and raped. A true and correct copy of one of Gold’s threats against me and the other Plaintiffs is attached hereto as Exhibit A.

76. In or around June 2023, shortly after Defendant Masterson was convicted, a known agent of Scientology tweeted about me and the other Plaintiffs:

Because those 3 women implied drug use by Masterson, every Scientologist in LA now knows they were lying. Scientologists just don’t use drugs. Every Scientologist who recognizes these women will spit on them, for the rest of their lives. I sure wouldn’t want to be them.

77. Later that day, the same known agent of Scientology tweeted:

Since these women live in LA and there are thousands of Scientologists in every walk of life in LA, the three women who lied in the Danny Masterson case will get spit on a lot. I don’t think they will take it out on the jury or judge since these were just fooled and manipulated by a false “expert witness”. But the 4 women will live in hell, now and for the rest of their lives.

A true and correct copy of this tweet is attached hereto as Exhibit C.

78. I have been targeted for harassment via social media, including by anonymous and/or unidentified individuals that utilized information that could be gathered only from the Corporate Defendants’ auditing files.

79. Since I reported Defendant Masterson’s sexual assaults to government authorities in or around December 2016, we have repeatedly been the subject of credit card fraud. We also have been subjected to fraudulent credit schemes that have resulted in creditors and collectors harassing us for payment on items and services that we did not order or receive.

80. I have been the victim of fake ads posted by Defendants and/or their agents on Craig’s List that purport to be me soliciting anal sex from strangers. I have subsequently received contact from men responding to the fake ads. Defendants and/or their agents have also created accounts purporting to be me on various dating and sex-solicitation websites.

81. In or around 2018, in an attempt to escape harassment, we moved and I changed my cell-phone number. But when friends and family would attempt to contact me at my new number, the calls were answered by a strange man. That same man would call my family on dates important to me (i.e. my birthday).

82. In or around May of 2019, I received messages from a person I did not know who asked me to meet him at 6331 Hollywood Boulevard, which is the headquarters of Defendant CSI, the purported residence of Miscavige, and a location from which both Defendant RTC and OSA operate.

83. In or around June 2019, an individual who was an agent of Defendants and a friend of Defendant Masterson’s contacted my husband and threatened to leak nude photos of me underage.

84. Defendants and their agents fraudulently registered my vehicle so that it appeared stolen.

85. In or around February 2020, my husband received threatening messages through social media that included our children. And I received messages threatening to falsify allegations to Child Protective Services in order to have my children taken away from me.

86. In or around August 2020, all the Los Angeles Unified School District accounts for our children were hacked so that all messages from the school and their teachers were locked. The passwords for the children’s virtual classroom accounts were also changed.

87. From around late 2020 through 2021, I received multiple alerts on my phone informing me that my SIM card had been stolen, that the SIM card in my phone had been removed, that a new SIM card had been installed, and that the real owner was looking for the phone.

88. In or around May 2021, via group chat, Mike Rinder congratulated me, Jane Doe #1, and Jane Doe #2 on our bravery and strength getting through the preliminary hearing. An unknown number then messaged the group chat threatening us in Spanish and insulting us.

89. Between around February and August 2021, our external cameras were disabled on four separate occasions.

90. In or around August 2021, my husband and I became aware that our external cameras were disabled at approximately 2:00 am. My husband and I went outside and discovered that a person had defecated outside our children’s bedroom window.

91. In or around August of 2021, my husband, who is a member of the band “The Mars Volta” received a threatening message that said, “Cedric from The Mars Volta bout to get murt by the Church of Scientology.”

92. In or around August of 2021, a white sprinter van which had been parked near our house followed me to my therapy appointment.

93. In or around late August 2021, an investigator with the Los Angeles District Attorney’s office confirmed that my and my husband’s phones had been compromised.

94. Around the time of the trial, I received a number of intimidating and threatening messages. One message in particular requested I dance to the song “Another One Bites the Dust,” which my children and I frequently played in the days prior to receiving the message.

95. I was removed from my health insurance multiple times (through no doing or fault of my own), and on one occasion had to pay out of pocket for a trip to the emergency room.

96. My husband and I had multiple issues with our bank accounts. One of our accounts was hacked on multiple occasions and our passwords were changed without our knowledge or consent. In or around February 2022, an unauthorized party caused the account to become overdrawn. These compromises often occurred alongside other technological issues that I experienced. On one occasion, my bank informed me that a new credit card would be mailed to me due to our account having been compromised, despite me having never received an alert that my account had been compromised.

Instances of Harassment Directed Toward Friends and Family

97. The harassment is not limited to me and my husband. My extended family has also been harassed and threatened by Defendants and/or their agents. On one such occasion a man called my sister and told her that she was “going to need to fix that windshield.” Shortly thereafter, a man tailgated my sister and then, while passing my sister’s car, threw a rock and shattered my sister’s windshield.

98. I have been informed that close friends and family, and other victims of Defendant Masterson’s sexual abuse, have received harassing calls from Defendants and/or their agents. Often, the caller will convey personal information about my friends and family members, such as when an unknown man called my mother and wished her a happy birthday by her first name. Scientology members would also connect or attempt to connect with my friends and family over social media.

Emotional Distress Resulting from Defendants’ Conduct

99. As a result of the foregoing, we continue to be in fear for our lives and the safety of our family and pets.

100. As a result of Defendants’ harassing conduct, I suffer from extreme anxiety, including violent night terrors. As a result, my husband Plaintiff Bixler-Zavala, has been forced to care for me and our children since Defendants’ campaign of harassment began. As a result of my night terrors, my husband and I have been forced to occupy separate bedrooms since Defendants’ campaign of harassment began. As a result of Defendants’ conduct, our marriage has suffered loss of consortium due to a loss of love, companionship, comfort, care, assistance, society, sexual relations, and moral support.

101. On multiple occasions, I told the individuals that were harassing me to cease their actions and have gone to law enforcement about the harassment. I also believe my responses, reactions, and actions, including the filing of this Complaint in or around August 2019, made it clear to the Defendants that I wanted them to stop harassing me. In any event, I believe that my safety and the safety of my family would be in jeopardy if I made additional attempts to directly confront Defendants’ agents regarding their harassing conduct.

[During the trials]

Last week we described how Scientology is trying to strike portions of the lawsuit filed by Danny Masterson’s victims, and they are fighting back by posting more details of the harassment they’ve been going through since they came forward to the LAPD in 2016.

That day, we showed you the stunning allegations by Jane Doe 1, and today, we have the declaration of Jane Doe 2.

Again, we ask you to imagine if this information were to be presented to a jury.

DECLARATION OF JANE DOE #2

I, Jane Doe #2, declaring under a pseudonym, declare as follows:

1. I am over the age of eighteen (18). I have personal knowledge of the facts stated below and, if called upon to do so, could and would competently testify thereto.

2. I am a Plaintiff in the case of Bixler, et al. v. Church of Scientology International, Inc., et al. proceeding under a pseudonym.

4. I was a practicing Scientologist when I was a child and, through my affiliation with the church, became familiar with members of Scientology, and organizations affiliated with Scientology, including The Church of Scientology International, Religious Technology Center, and Church of Scientology Celebrity Centre International, David Miscavige and Daniel Masterson (“Defendants”).

5. Previously, I had reported a rape by a Scientologist to Scientology and was directed to not report the rape to governmental authorities. When I reported the rape, I was shown Scientology policies prohibiting me from contacting the authorities. I was also shown policies prohibiting me from accusing a fellow Scientologist of rape, even if the accusation was reported only to Scientology. I understood that if I did report the assault to Scientology, it would not result in any action being taken except to publicly shun, shame, and harass me.

6. In 2017, I disclosed Defendant Masterson’s assault to the LAPD. From the time I disclosed Defendant Masterson’s assault to the authorities through the present, I have been stalked, harassed, and intimidated by Defendants and their agents in retaliation for reporting my abuse and in an attempt to silence me.

7. In or around May 2023, Defendant Masterson was convicted of raping me, and on or around September 2023, Defendant Masterson was sentenced to imprisonment for a period of 30 years to life.

Instances of Physical Surveillance and Harassment

8. Shortly after reporting that Defendant Masterson raped and sexually assaulted me to the LAPD, I observed two people, one of whom I know to be a Scientologist, surveilling my home.

9. Within a week of reporting my rape and sexual assault to the LAPD, a Sea Org member came to my house seeking to speak with me. The Sea Org member initially refused to leave when I told him that I did not want to speak with him.

10. Shortly after contacting the LAPD, I was retrieving something from my vehicle parked in front of my home when an individual, who I know to be a Scientologist, slowly pulled into a nearby driveway and stared at me until I went back inside my home.

11. Starting shortly after I contacted the LAPD, my car started being vandalized. On multiple occasions, when my car was parked on the street near other cars, my car suffered damage (for example, the driver-side rear-view mirror was removed and my entire front windshield was broken and needed to be replaced) while the surrounding cars were untouched.

12. In one instance, in or around the end of 2017 or the beginning of 2018, I was in Echo Park in Los Angeles, California with a friend when we noticed that an unknown man was watching us from a bench and photographing us. When my friend and I walked away, the man followed us for approximately an hour and continued to photograph us.

13. In or around late 2017 or early 2018, I was followed around a grocery store by a Sea Org member known to me as Maverick.

14. In or around February 2018, I was at a grocery store when [Ilaria] Urbinati, who had since become a business partner of Defendant Masterson’s, approached me and told me that Leah Remini was putting me “up to this,” and asked why I and Plaintiff Bixler were “doing this to Danny?” Urbinati went on to interrogate me and to attempt to get me to admit I was lying about being raped and assaulted by Defendant Masterson. She also told me that Bixler was “insane” and that Masterson had not raped me. Urbinati persisted despite me repeatedly asking Urbinati to leave me alone.

15. In or around 2020, a man claiming to be from the U.S. Census Bureau knocked insistently on my door. When I told him to leave, he refused and instead began peering through my window and took notes for ten minutes. This man did not go to any of my neighbors’ homes, and when I called the Census Bureau, they were unable to confirm the man was associated with the Census Bureau.

16. After a 2020 meeting with Plaintiff Bixler and an attorney, Plaintiff Bixler and I were in Bixler’s parked car when a vehicle began to circle us. The occupants were waving and smiling in a disconcerting manner and mimicking the taking of pictures.

17. On two separate occasions in or around 2021, I noticed unknown men parked outside of my home for long periods of time. On the first occasion, the vehicle’s occupant appeared to be observing me and taking notes. On the second occasion, I saw what appeared to be electronic equipment in the passenger seat and center console. When I confronted the occupant, the man told me to fellate him. A neighbor of mine has also reported seeing individuals sitting in their vehicles outside of my home on several occasions.

18. On another occasion in or around 2021, I was walking to my vehicle parked on the street outside of my house when I noticed a man parked in a car near my vehicle. As I approached my vehicle, the man drove his car directly behind my vehicle and stayed there, blocking a driveway. Once there, he stared at me and took notes until I drove away.

19. In or around 2022, my mailbox was broken into and my mail was stolen.

20. In or around 2022, one of my grocery deliveries was tampered with and unsealed jars containing strange liquid were delivered to me.

21. In or around 2022, a man contacted me and told me that he was going through the same sort of harassment that I was experiencing and told me that he could help me. He pressured me to call him where he lived in New York (a one-party consent state for recording calls). I later determined that the man is connected to friends of Defendant Masterson.

22. During Defendant Masterson’s criminal trials, on several occasions I noticed that unidentified men were following me while I was in downtown Los Angeles. For example, during the first trial while awaiting the jury verdict, unidentified men followed me on-foot inside and around the hotel.

23. In or around early 2023, shortly before I was scheduled to testify in Masterson’s retrial, new tenants moved into the property whose backyard is a few feet from my entire apartment, including my bedroom and living room. Now, whenever I go to sit outside, those tenants also go into their backyard and begin making a racket. For example, during one six-day period, the tenants mowed their lawn every day, despite it being a very small lawn, would use power tools for hours often and for days on end, and would peer into my windows. The tenants also engage in behavior that appears to target me, including, the night before Defendant Masterson’s criminal trial was set to begin, loudly playing an obscure song that I had posted on Twitter the prior day.

24. In or around early 2023, a car with tinted windows parked directly next to me as I parked in a grocery store parking lot. Despite the tinted windows, I could see a man sitting in the car working on a laptop. I stared at the car as I entered the grocery store and the car drove away. After returning from the grocery store, I saw the same car had reparked next to my car and when I started to confront the man, he began to leave again. I confronted the man and asked him if he was Scientology, he made a joke and drove away.

Instances of Electronic and Online Harassment

25. Shortly after reporting that Defendant Masterson raped and sexually assaulted me to the LAPD, I also began to receive copious amounts of mail, phone calls, and text messages from numbers associated with the Sea Org. I frequently received voicemails from Defendants and/or their agents urging me to call them to return to Scientology to help me cope with the death of my father by suicide (despite my father not being a Scientologist and having died 12 years prior).

26. I have received numerous phone calls from individuals who either do not speak or make sexual noises.

27. Defendants and their agents have created numerous fake social media accounts purporting to be created by me, which they have used to try to discredit me.

28. I have been consistently harassed via social media by Defendants and their agents, including being accused of serious criminal offenses, being accused of being a Satanist, and being accused of being a part of “Pizzagate” and being a pedophile.

29. In or around September and October 2018, Defendants’ agent Kathy Gold started publicly threatening me and the other Plaintiffs, and their relatives. Gold accused me and the other Plaintiffs of being religious bigots and liars and threatened to commit serious and violent crimes against us, including murder. A true and correct copy of one of Gold’s threats against me and the other Plaintiffs is attached hereto as Exhibit A.

30. In or around June 2023, shortly after Defendant Masterson was convicted, a known agent of Scientology tweeted about me and the other Plaintiffs:

Invasion of Personal Devices and Accounts

32. An investigator with the Los Angeles District Attorney’s office confirmed in late August 2021 that my phone and computer had been compromised.

33. I have experienced substantial issues with my cell phone and computer that suggest my phone and computer have been hacked or otherwise compromised. During my phone calls, I have heard an irregular clicking noise, interference, and my calls sometimes abruptly drop. Frequently, my calls connect to the other party, but neither party can hear each other talk. There were also occasions that I heard voices during telephone conversations other than the person to whom I was speaking. My phones and computers sometimes scroll or take screenshots by themselves, the settings on my phones have changed without my changing them, and my phones have frequently indicated that they are located in cities they are not in. Text messages on my phone between myself and other Plaintiffs have also disappeared, despite my not deleting the messages. And numerous other files on my phone have been deleted, despite me not deleting them.

34. I have experienced continual interference with my internet and WiFi and my service provider has determined the interference is not due to any faulty equipment.

35. On multiple occasions, with both doctors and attorneys, I called the number associated with the service provider and provided personal confidential information. I would later make a follow up call and be told that the service provider had no record of my initial call.

36. Many of my social media accounts have been hacked, including my Twitter and Instagram accounts. Shortly after publishing a post on Instagram indicating that I was not afraid of Scientology, my Instagram account was deleted without my knowledge or approval. Defendants and their agents have caused my business social media accounts to be deindexed by Google or to appear unnaturally far down in Google search results.

37. My accounts with several service and utility providers have been hacked and I have had my passwords changed on those accounts without my authorization.

38. In or around late 2017 or early 2018, Defendants and their agents uploaded unflattering pictures of me to IMDB and associated those pictures with my entry in that database.

39. In or around March 2019, I made a post to social media in which I called on the FBI to investigate Scientology. In the days immediately following, Defendants and their agents, without my authorization, charged approximately $4,000.00 of merchandise from Victoria Secret and vitamin suppliers to my bank account, and had those items delivered to my house.

40. In or around late 2020 or early 2021, I searched myself on Google Images. The results returned several images of women that bore a resemblance to a younger version of me, with my name appearing under the pictures. The pictures directed the user to pornographic web sites. Within minutes of reporting this to the authorities, the pictures were removed.

41. Despite not having shared my Pandora account information with any third parties, my Pandora account sometimes notifies me that “Someone else is listening to your Pandora right now. You are sharing this with another listener.”

Emotional Distress Resulting from Defendants’ Conduct

42. As a result of the harassment I have suffered, I have rarely left my home in the years since reporting Defendant Masterson’s sexual assault to the authorities. I have struggled with Fibromyalgia, insomnia, migraines, nausea and vertigo, extreme fatigue, sciatica, anxiety, posttraumatic stress disorder, complex post-traumatic stress disorder, agoraphobia, and depression.

43. As a result of the foregoing, I continue to live in fear for my life and the safety of my family.

44. On multiple occasions, I told the individuals that were harassing me to cease their actions and have gone to law enforcement about the harassment. I also believe my responses, reactions, and actions, including the filing of this Complaint in or around August 2019, made it clear to the Defendants that I wanted them to stop harassing me. In any event, I believe that my safety and the safety of my family would be in jeopardy if I made additional attempts to directly confront Defendants’ agents regarding their harassing conduct.

I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.

1996: David Mayo posted this week to clarify a point of authorship: who created Body Thetans? “I did not invent/create/come up with the idea of body thetans or the OT III materials or the story contained therein. I did not write the OT levels that I think of and used to be known as I – VII (the ‘old ones’). Incidentally, I think considerable confusion has existed and probably still exists as to what these levels are, as some of those have changed a few times over the years, e.g., I knew of four different versions of ‘OT I’ and that doesn’t include a _possible_ new, different (5th) version of it after I left. As for NOTs and Solo NOTs the question of who authored that material has been the subject of extensive litigation (from 1985) and there are related appeals pending before the 9th Circuit (hearing held on November 14, 1995, awaiting decision). The statement that I consider the most accurate on authorship of these materials was made by Special Master Kolts in his opinion and order of April 17, 1992: (This opinion and order was endorsed and adopted by the judge, Hon. James Ideman.) ‘Pursuant to the sanctions order, plaintiffs are prohibited from denying that defendant Mayo substantially participated in the drafting of NOTs.’ Some have advised me that it would be better for me public relations wise to not litigate on this matter and to allow the Scientology plaintiffs’ assertions that L. We were just out of court yesterday at the hearing in Leah Remini’s lawsuit when we heard the news that Danny Masterson’s new appellate attorneys had moved for him to be freed on bail while he’s appealing his convictions.

Judge Charlaine Olmedo has scheduled a hearing for this week to hear this argument, but does it stand a realistic chance of succeeding? We suspect that it’s a non-starter, but we still marvel at what money buys for wealthy clients.

We thought you’d want to see that as well, and what better way than to show you the whole enchilada, the entire motion for bail filed by Masterson’s new appellate attorneys, Cliff Gardner and Eric Multhaup.

We know there’s a lot of impenetrable legal stuff in the middle, but the initial parts are pretty interesting as these two highly paid attorneys try to portray convicted serial rapist Masterson as an asset to the community who won’t make a run for it if he’s let out of custody.

But they are also, at the end, making an argument that there is new exculpatory evidence that the jury never got to hear, involving four witnesses that the LAPD interviewed in 2004. But whatever that evidence is, it was redacted from this public version of the document.

Well, read what is there and let us know if you think that there’s any chance that Judge Olmedo bites on it.

NOTICE OF MOTION AND MOTION FOR BAIL ON APPEAL

To the Hon. Charlaine P. Olmedo, Los Angeles Superior Court: Defendant Daniel Masterson through his attorneys Clifford Gardner and Eric Multhaup moves the Court for an order granting bail on appeal pursuant to Penal Code sections 1272, subd. (3) and 1272.1. As set forth in the accompanying Memorandum of Points and Authorities and Exhibits, defendant far exceeds the criteria for bail on appeal set forth in Penal Code section 1272.1. In fact, defendant is among the most deserving candidates for bail on appeal that a court will encounter due to two unusual aspects of this case.

First, for the past 20 years, defendant has led an exemplary law-abiding life devoted to his family, his community and to many charitable and humanitarian causes. That unblemished track record uniquely establishes the strength of his ties to the community and his lack of dangerousness to any other person, including the complaining witnesses in this case.

Second, counsel for defendant will raise an appellate issue regarding the expiration of the statute of limitations that is significantly stronger than the arguments previously presented to this Court. Counsel have delved into the legislative history of Penal Code sections 799 and 805 in a manner that was not done in People v. Perez (2010) 182 Cal.App.4th 231 or in any other published case. The result of this analysis clearly demonstrates that an allegation of multiple victims under Penal Code section 667.61(e)(4) is an “enhancement” within the meaning of the Penal Code section 805(a) admonition that “[a]ny enhancement of punishment prescribed by statute shall be disregarded in determining the maximum punishment prescribed by statute for an offense.” Therefore, the section 667.61 allegation does not abrogate the normal 11 year statute of limitations prescribed for rape in Penal Code section 801.1. This argument weighs strongly in favor of granting bail on appeal because a decision in defendant’s favor will result in complete termination of the prosecution, not merely in a reversal of the judgment.

In addition, a defendant may apply for post-conviction bail pending habeas corpus proceedings pursuant to Penal Code section 1476. Post-conviction counsel are actively pursuing habeas corpus relief concurrently with the appeal, based in part on extensive exculpatory evidence that was not presented to the jury. As an indication of the tenor and quality of this evidence, counsel has attached summaries of four witness interviews conducted by Det. Myers of the L.A.P.D. in 2004 in response to Jenn B.’s complaint. These interviews contain information highly favorable to defendant that informed the District Attorney’s decision not to prosecute at this time. Counsel for defendant has concurrently filed a motion to submit these interview reports under seal with service on the District Attorney to avoid undue media attention to this complaining witnesses and to the exculpatory witnesses.

This motion is based on the accompanying Memorandum of Points and Authorities, the Exhibits attached to the Sentencing Memorandum, and such further evidence and argument as may be presented at the hearing of this motion.

MEMORANDUM OF POINTS AND AUTHORITIES

I. THE STATUTORY FRAMEWORK FOR BAIL ON APPEAL

Penal Code section 1272.1 provides as follows:

Release on bail pending appeal under subdivision (3) of Section 1272 shall be ordered by the court if the defendant demonstrates all the following:

(a) By clear and convincing evidence, the defendant is not likely to flee. Under this subdivision the court shall consider the following criteria:

(1) The ties of the defendant to the community, including his or her employment, the duration of his or her residence, the defendant’s family attachments and his or her property holdings.
(2) The defendant’s record of appearance at past court hearings or of flight to avoid prosecution.
(3) The severity of the sentence the defendant faces.

(b) By clear and convincing evidence, the defendant does not pose a danger to the safety of any other person or to the community. Under this subdivision the court shall consider, among other factors, whether the crime for which the defendant was convicted is a violent felony, as defined in subdivision (c) of Section 667.5

(c) The appeal is not for the purpose of delay and, based upon the record in the case, raises a substantial legal question which, if decided in favor of the defendant, is likely to result in reversal. Where a defendant presents sufficient evidence to objectively satisfy the clear and convincing evidentiary standard as to Penal Code sections 1272.1(a) and (b), and where the defendant raises a substantial legal question under section 1272.1(c), the court must order the defendant released on bail as a mandatory duty, not a discretionary decision. See In re Podesto (1976) 15 Cal. 3d 921; In re Pipinos (1982) 33 Cal.3d 189.

II. DEFENDANT’S ENTITLEMENT TO BAIL ON APPEAL UNDER THE STATUTORY FACTORS.

A. The Unlikelihood that Defendant Will Flee if Granted Bail on Appeal.

1. Defendant’s ties to his family and to the community.

Defendant’s family moved to Los Angeles in 1992 when defendant was 16 years old. He has lived in southern California ever since, in Los Angeles itself until 2018, and then in Santa Barbara County town of Santa Ynez since then. Before his family moved to Los Angeles, defendant had a thriving career as a child model and actor closely supervised by his mother, Carol Masterson. In Los Angeles, he expanded into television roles and was successful. He has maintained a close family relationship with his mother and with his three younger brothers and one younger sister, who all live in the Los Angeles area. He has also maintained a strong relationship with his father, who lives on the East Coast. See Exhibit 1, letter from Carol Masterson, August 16, 2023; Exhibit 2, letter from Alanna Masterson, August 2, 2023. [These good character letters have been selected from the good character letters submitted with defendant’s Sentencing Memorandum.]

In 2004 when defendant was 28 years old, he met Bijou Philips, who was also working in the entertainment industry. They began dating, became exclusive, and married in 2011. After multiple miscarriages and medical problems, as set forth in the letter from Bijou Philips, August 23, 2023, they had a daughter in 2014. Defendant cared for both the daughter and Bijou, who described him as a “life-saving partner” in her letter. She describes defendant as an exemplary father. Exhibit 3.

Also, during this period, defendant engaged in significant philanthropic efforts, particularly with an organization devoted to helping long-term disabled first-responders, fire-fighters and police in the aftermath of 911.

Theresa Ashton, executive assistant for the two largest law enforcement unions in New York, attests that defendant was very active in post-911 charitable activities for first responders, and “raised millions of dollars so that rescue workers could receive free medical care for a decade.” Exhibit 4, letter of Theresa Ashton, July 24, 2023. For these efforts, he was awarded the Ellis Island Medal of Honor in 2013. See: medalists.eihonors.org.

Retired New York Fire Department Lt. Patrick McGreen attests to defendant’s extensive charitable efforts for 911 first responders and to defendant’s assistance to Lt. McGreen himself when he was ill. Exhibit 5.

In 2017, the complaining witnesses made their charges against defendant and by 2018, defendant had been ostracized from his acting career in the aftermath of the complaints. He and his family moved to a more rural setting in Santa Ynez. He formed close relationships with members of the local viticulture industry, with law enforcement agents, and his neighbors. See Exhibit 6, letter from Ryan Smith, July 23, 2023; and Exhibit 7, letter from Chris Atkinson, August 3, 2023. Until the verdict in this case, he lived a quiet but productive life in Santa Ynez with his wife and daughter, with frequent visits by his parents and siblings.

Since his incarceration, he continues to speak with his family and friends as much as the custodial communications system will permit, and his family ties remain as strong as ever. However, they are severely attenuated with respect to direct contact, which is particularly acute with respect to his nine year old
daughter.

Defendant has no practical ability to flee if released on bail. He has surrendered his passport to authorities. He is a publicly recognizable figure due to the international syndication of his television shows, to the extent that he has no place to go where he could be anonymous.

2. Defendant’s record of appearance at past court hearings.

Defendant has an unblemished record of court attendance.

3. The severity of the sentence.

The sentence of 30 years to life is certainly severe, but it did not deter defendant from appearing for the announcement of the verdict, and would not deter from defendant from complying with all terms of bail on appeal.

B. The Absence of Any Danger Posed by Defendant to Any Other Person or to the Community.

Defendant uniquely qualifies for bail on appeal under this criterion because he has lived the past 20 years in an exemplary manner in every aspect of his life since 2003 when the last of the incidents giving rise to the charges occurred. As set forth in the Sentencing Memorandum, defendant has demonstrated beyond a shadow of a doubt that he is a devoted husband, a loving father, and a contributing member to his local community and to larger social causes. As noted above, he made extraordinary efforts on behalf of a New York City charitable organization dedicated to helping first responders and law enforcement personnel suffering from long term disabilities arising from their service on 9/11. See Exhibits 4 and 5.

The outpouring of heartfelt testimonials to his good character and positive life-style during the past 20 years demonstrate far beyond clear and convincing evidence that defendant would lead a law-abiding life if granted bail on appeal. This is a very rare case in that the defendant’s 20 years of law-abiding life provide overwhelming evidence that he would continue to do so if granted bail on appeal.

C. Defendant Will Raise an Appellate Issue of Manifest Substance that Will Result in Reversal of the Judgment and Preclude Re-Prosecution.

1. Introduction and summary.

To meet the showing required by Penal Code section 1272.1, subd. (c), the undersigned counsel have delved into the legislative history of Penal Code sections 667.61, 799 and 805, and have developed significantly stronger arguments than were previously presented in this court that the prosecution was barred by the statute of limitations. Counsel are not asking this Court to revisit its prior ruling, but are asking that the Court recognize that the statute of limitations argument presented here is far stronger and thus more supportive of granting bail on appeal than were the arguments previously presented to the Court.

In short, the legislative history of Penal Code sections 799 and 805 is abundantly clear that the Legislature intended that both traditional base term plus add-on enhancements as well as alternative penalty provisions “shall be disregarded in determining the maximum punishment prescribed by statute for an offense.” Penal Code section 805, subd. (a).

That legislative history was not made known to or otherwise considered by the court in People v. Perez, supra, which this Court cited as controlling authority in its September 7, 2023 denial of defendant’s motion for mistrial. This Court may have been bound to follow Perez by stare decisis, but is not so limited in determining whether the current version of the argument meets the Penal Code section 1272.1(c) requirement of a substantial legal question for purposes of bail on appeal.

2. The clear and unambiguous legislative history of sections 799 and 805 demonstrates that a Penal Code section 667.61 allegation must be disregarded in determining the statute of limitations for the rape charges.

a. The 1984 legislative overhaul of the statute of limitations provisions.

The legislative history of Penal Code sections 799-805 began in 1981, when the Legislature passed Stats., 1981, Chapter 909, section 3, which directed the California Law Revision Commission [hereafter “LRC”] to study the then-existing patchwork of statute of limitations provisions applicable to felonies and to make recommendations for simplifying and clarifying them.2 The LRC responded in 1984 with a Recommendation Relating to Statues of Limitations for Felonies, 17 Cal. L. Revision Comm’n Reports 301 (1984). The Report described the state of the law as “complex and filled with inconsistencies.” Id. at 307. The Report also provided “Recommended Legislation” designated as Penal Code sections 799 to 806 to replace the existing patchwork, Id. at 317 – 324. The legislature enacted the L.R.C. recommendations virtually verbatim. Stats. 1984, ch. 1270, Section 2.

b. The express directive in section 805(a) that “[a]ny enhancement of punishment prescribed by statute shall be disregarded in in determining the maximum punishment
prescribed by statute for an offense.”

The Legislature enacted section 805(a) in haec verba with the L.R.C. recommendation:

(a) An offense is deemed punishable by the maximum punishment prescribed by statute for the offense, regardless of the punishment actually sought or imposed. Any enhancement of punishment prescribed by statute shall be disregarded in determining the maximum punishment prescribed by statute for an offense (emphasis supplied).

The underscored portion in plain language categorically excludes a punishment-enhancing provision from being considered in determining the maximum punishment for an offense for statute of limitations purposes. The key issue here is what provisions the Legislature intended to include within the term “enhancement of punishment prescribed by statute.”

c. The L.R.C. Comment that explains the intended scope of the term “enhancement of punishment prescribed by statute” in section 805(a).

The L.R.C. Recommendation for the text of section 805(a) was accompanied by a Comment, 17 Cal. L. Revision Comm’n Reports at 323, and that Comment accompanies current section 805(a) verbatim:

The punishment for an offense is determined without regard to enhancements over the base term for the purpose of determining the relevant statute of limitation. See, e.g., §§ 666–668 (enhancement of punishment for habitual criminals). For the definitions of “base term” and “enhancement,” see Rule of Court 405.

That Comment is deemed directly indicative of the legislative intent underlying the statute under consideration. See Rojas v. Superior Court (2004) 33 Cal.4th 407, 418 n.7 [“The official comments of the California Law Revision Commission on the various sections of the Evidence Code are declarative of the intent not only of the draft[ers] of the code but also of the legislators who subsequently enacted it.”]. Accord: People v. Williams (1976) 16 Cal.3d 663, 667-668.

Thus, the Comment cited Penal Code sections 666, 667, and 668 as examples of the types of enhancements that were to be disregarded in determining the statute of limitations for a particular charge. Penal Code section 666 is an enhancement that provides an alternative and more severe penalty for a charge of petty theft if a prior conviction is pled and proven for a specified list of prior theft offenses.3 Section 666 is obviously not a ”base term” plus “enhancement” provision, but is functionally indistinguishable in its effect.

Section 666 has been repeatedly construed as a sentence enhancement provision. People v. Bouzas (1991) 53 Cal.3d 497 resolved a split of authority as to whether the proof of the prior conviction portion of section 666 was an element of the current offense, or whether it was a sentencing enhancement. The answer to that question was relevant to the issue of whether a defendant could stipulate to the fact of a prior conviction and keep that fact from the jury, or whether the fact of the prior conviction was an element of the offense in which case the jury would have to be apprised of the charge pursuant to Article I, section 28 – “article I, section 28, subdivision (f) now provides, ‘When a prior felony conviction is an element of any felony offense, it shall be proven to the trier of fact in open court.’.” 53 Cal.3d at 476. The Supreme Court concluded that section 666 was a “sentence-enhancing statute”:

In other words, a charge under section 666 merely puts a defendant on notice (see § 969 [prior convictions must be alleged in the information]) that if he is convicted of the substantive offense and if the prior conviction and incarceration allegation of section 666 is admitted or found true, he faces enhanced punishment at the time of sentencing. We conclude that, on its face, section 666 is a sentence enhancing statute, not a substantive “offense” statute. 53 Cal.3d at 479.

Thus, section 666 was deemed a “sentence-enhancing statute” for purposes of determining whether the fact of the prior conviction has to be adjudicated by a trier of fact or whether it could be stipulated by the defendant. Bouzas’ recognition of section 666 as a “sentence-enhancing statute” is consistent with the legislative intent to include section 666 and its ilk within the phrase “[a]ny enhancement ” in section 805(a).

The other two examples in the Comment of sentence enhancing statutes that were excluded from consideration in statute of limitations determinations were Penal Code sections 667 and 668. Both of these are structured in the “base term” plus “enhancement” format. Section 667 [“nickel prior”] provides for a five year enhancement for a current conviction of a serious felony where the defendant has previously been conviction of a serious felony. Section 668 provides that a conviction in a different jurisdiction that could have been punished in California by a prison term “is punishable for any crime subsequently committed within this state in the manner prescribed by law and to the same extent as if that prior conviction had taken place in a court of this state.”

Sections 667 and 668 have the same operative effect as section 666 – enhanced punishment – but they employ a different mechanism to impose that punishment. Section 666 abrogates the standard statutory punishment for the charged offense, and substitutes an alternative and more severe punishment upon proof of an aggravating factor. Sections 667 and 668 retain the basic statutory punishment for the charged offense, and impose an additional term of punishment for an aggravating factor. The Comment is clear and unequivocal that both types of enhancement provisions “shall be disregarded” for statute of limitations purposes.

Penal Code section 667.61(e)(4), enacted in 1994, is functionally indistinguishable from section 666. “[S]ection 666 operates like the Three Strikes law and section 667.61; it does not establish an enhancement, but establishes an alternate and elevated penalty for a petty theft conviction when a recidivist has served a prior term in a penal institution for a listed offense.” People v. Murphy (2001) 25 Cal.4th 136, 155.

Given that the Comment expressly specifies section 666 as an example of an enhancement that “shall be disregarded” in determining the statute of limitations for a particular offense, and given that section 667.61 is functionally indistinguishable from section 666, the conclusion is compelled that section 667.61(e)(4) is a sentencing-enhancement provision that the Legislature intended to exclude from statute of limitations determinations.

d. The legislative placement of section 667.61 within the statutory range of sections 666 – 668 cited in the Comment as excluded from statute of limitations determinations.

It is a well-settled principle of statutory construction in California and in American jurisprudence generally that in construing a statute, the reviewing court should consider where the Legislature has elected to place the statute under consideration. People v. Bouzas, supra, 53 Cal.3d at 478-479 invoked this principle in construing section 666:

Section 666 is – and has been since 1872 – part of title 16 of the Penal Code, which is directed primarily to sentencing and punishment matters, to the exclusion of statutes defining substantive crimes (see Cooks, supra, 235 Cal.App.2d at p. 10 [history of former §§ 666 & 667]). This supports our conclusion that the Legislature has long intended that section 666 establishes a penalty, not a substantive “offense.”

See also Roman Catholic Bishop of Oakland v. Superior Court (2005) 128 Cal.App.4th 1155, 1169 [“the statute’s placement” is a “strong indicator[] of the Legislature’s intent”]; People v. Silverbrand (1990) 220 Cal.App.3d 1621, 1626 [“in determining legislative intent, we begin with the most obvious clue: the placement of the statute”]; Newman v. Sonoma County (1961) 56 Cal.2d 625, 627.

The Legislature elected to place section 667.61 within the range of statutes designated in the section 805 Comment as examples of statutes to be disregarded for statute of limitations purposes. The Legislature is presumed to have related statutes in mind when enacting a new statute:

“We construe the words in context of related statutes, harmonizing them whenever possible. (Ibid.) We presume the Legislature was aware of existing related laws” when it enacted section 1170.95, and that it “intended to maintain a consistent body of rules.” (People v. Superior Court (Zamudio) (2000) 23 Cal.4th 183, 199. In re R.G.(2019) 35 Cal. App. 5th 141, 146.

The very specific placement of section 667.61 within the range of statutes designated in the section 805 Comment, reflects the Legislature that it be treated the same as surrounding its neighbors for statute of limitations purposes, i.e., another instance of the penalty enhancement statute that “shall be disregarded” for statute of limitations purposes.

e. The term “enhancement” has been construed in other contexts to include both “base term” plus “enhancement” provisions and alternative penalty provisions.

People v. Brookfield (2009) 47 Cal.4th 583 confirms that prior to 1997, the Legislature’s use of the term “enhancement” referred both to traditional enhancements and alternate penalty provisions. Defendant Brookfield argued that the Legislature’s use of the term “enhancement” in section 12022.53, subdivision (e)(2) included both “base term” plus “enhancement” provisions and alternate penalty provisions. (Id. at p. 592.) That argument is directly comparable to that of defendant here.

The Court recognized that the question was one of legislative intent. (Ibid.) The Court noted that “decisions of this court in the last decade” drew a sharp distinction between “penalty provisions and sentence enhancements.” (Ibid.) These cases made clear that the term “‘enhancement’ refers only to a sentence enhancement, not a penalty provision.” (Id. at p. 593.) But these cases had not “been decided when the Legislature enacted section 12022.53 [in 1997]” and, as such, “the Legislature did not have the benefit of this court’s later decisions that have given the term ‘enhancement’ the narrow meaning that the Attorney General argues we should apply to that term . . . .” (Ibid.) Accordingly, “as used in the statute, the word ‘enhancement’ includes not only . . . sentence enhancements . . . but also . . . alternate penalty provisions . .
. .” (Ibid.)

f. The absence of any reference to or discussion of any statute of limitations impact by the enactment of section 667.61 in its legislative history.

Counsel for defendant have scoured the legislative history of section 667.61, and there is no reference to or discussion of any possible impact it might have on the statutes of limitations for the underlying offenses to which it applied. The Legislature is presumed to be “aware of existing related laws” when it enacts a new statute, In re R.G. (2019) 35 Cal. App. 5th 141. Surely the legislative history would have noted and discussed the statute of limitations ramifications of enacting section 667.61 if it intended to in effect repeal the existing Penal Code section 801.1 statute of limitations for rape and dispense with any statute of limitation entirely.

g. The failure of People v. Perez to consider or address the legislative intent as to the meaning of the term “enhancement of punishment prescribed by statute” in
Penal Code section 805(a).

People v. Perez, supra, never addressed the crucial question of what the 1984 Legislature intended to include within the term “enhancement of punishment by statute” in section 805(a). Rather, the Perez analysis is based solely on the judicial distinctions drawn between alternative penalty provisions and base term/enhancement provisions in cases that had nothing to do with statute of limitations issues.

Perez relied heavily on People v. Jones (2009) 47 Cal.4th 566, see 182 Cal.App.4th at 237 – 239, but Jones merely held that a 20 year firearm use enhancement under Penal Code section 12022.53(c) could be imposed on a defendant who had been convicted of violating Penal Code 246 with a street gang enhancement that carried a punishment of 15 years to life. There was no statute of limitations issue in the case. Jones did confirm that the Penal Code section 186.22 gang enhancement was an “alternate penalty provision” and not a “sentence enhancement” because it “because it does not add an additional term of imprisonment to the base term,” 47 Cal.4th at 576. That unremarkable observation is irrelevant to determination of legislative intent whether “enhancement” as used in section 805(a) includes both alternate penalty provisions and base term plus additional punishment provisions.

Perez also relied on People v. Brookfield, supra, a companion case to Jones, which held that the trial court erred in imposing a Penal Code section 12022.53 firearm use enhancement on a defendant who was convicted of violating Penal Code section 246 with a gang enhancement finding, but who did not personally discharge the firearm. Again, no statute of limitation issue was involved.

Perez then noted that “the primary recommendation of the Law Revision Commission [in 1984] [was] that the length of a ‘limitations statute should generally be based on the seriousness of the crime’.” Id. at 242. Perez then concluded without any reference to the enhancement exclusion of section 805 that “[d]efendant’s crimes were serious enough to earn him a life sentence; therefore they were serious enough to warrant prosecution at any time during his natural life id. at 243 – 43.

That conclusion simply ignored the operative language of section 805(a) that enhancements “shall be disregarded” in determining the applicable statute of limitation, and for that reason is of very dubious persuasive value. For these reasons, defendant urges this Court to recognize that defendant has raised a very substantial legal question as to the very validity of this prosecution at all, which surely exceeds the Penal Code section 1272.1(c) requirement for granting bail on appeal.

D. The Anticipated Habeas Corpus Proceeding as an Additional Reason for Granting Bail on Appeal.

CONCLUSION

Defendant requests that this Court grant bail on appeal, and offers to comply with any relevant terms and conditions imposed by the Court that enable him to be an at-home parent and financial provider for his family, including house arrest and/or participation in an electronic monitoring program administered by the probation department.

WHEREFOR, for the foregoing reasons, defendant requests that this Court grant bail on appeal.

2001: The Marin Independent Journal reported that a California court has found Gerry Armstrong in contempt for speaking out against Scientology. “Marin Superior Court Judge Vernon Smith ruled that Armstrong, a former Scientology archivist, violated an earlier settlement agreement that he stop criticizing the church and discussing the experiences he had within the organization. Smith also issued an arrest warrant for Armstrong, who did not attend yesterday’s court hearing. Reached at his home in British Columbia, Armstrong said he intentionally stayed away from court for fear he would be thrown in jail. Armstrong said he also has no intention of curbing his criticism, which most often takes the form of writings he posts in Internet discussion groups. ‘This is about freedom of speech, freedom of religion, freedom of assembly, the whole gamut. I will fight this to the ends of the Earth.’ In making their case for a contempt order against Armstrong, attorneys for the church submitted a sheaf of messages Armstrong had posted on the Internet between March 1998 and last July. Quiros, the Scientology spokesman, said ‘We’ll probably never see a dime from Mr. Armstrong,’ he said. ‘And I doubt he’ll do any jail time because he will probably never come back to California.'” Gerry Armstrong posted his comment on the ruling to a.r.s.: “They are still faced with the same problem they had, only it’s bigger. This little big win may have cost them a million. And nothing happened. Their need to lie only serves to convince me that I am without the slightest doubt correct in my studied assessment and judgment that Scientology’s ‘contract’ is legally unenforceable, that Judge Thomas’s injunction is unlawful, that $cientology has unclean hands throughout this litigation, and that $cientology and their lawyers know these facts to be true. For my first contempt, which was for sending Judge Whyte my declaration about being threatened by attorney Andy Wilson after I was served by Grady Ward in $cientology v. Ward, Judge Thomas sentenced me to 2 days in jail and fined me $2,000. For my next 13 contempts, which were mainly talking about my religious experiences to people in Germany, Judge Thomas sentenced me to 26 days in jail and fined me $2,600, or $200 each. In this latest effort by $cientology, having me charged with 133 contempts, Judge Smith has not sentenced me to any jail time nor fined me. The clear message to me is that by continuing to communicate more and more about my religious experiences and religious beliefs, and committing more and more violations of the unlawful Thomas injunction, I have brought the price of contempt down to zero. And continuing the trend, $cientology will now be paying me to speak and write. I’m inspired.”

The civil case against Scientology and Danny Masterson, laid out in detail

Last month, we told you that the lawsuit filed by Danny Masterson’s victims was about to go through some big changes. The Jane Does suing Masterson and Scientology had submitted a new proposed version of the lawsuit that would add another plaintiff (actress Tricia Vessey), and also add sexual battery allegations against Masterson as well as civil RICO counts as they seek to prove that Scientology is a criminal enterprise.

It’s exciting stuff, but while we wait to see whether Judge Upinder Kalra will allow the new complaint, there is still the matter of the motion to strike that Scientology filed to remove significant portions of the previous version of the lawsuit, which dates back to 2020.

The Jane Does are opposing that motion to strike, and there’s a hearing scheduled for February 13 to argue the matter. In anticipation of that, the Jane Does and their legal team have submitted oppositions to Scientology’s motion, and the individual women have also submitted very interesting declarations spelling out their allegations against Masterson and Scientology.

Who better than the victims themselves to explain this case, right? And to detail the kinds of harassment that they have been going through since they came forward to the LAPD.

Here then is the declaration of Jane Doe #1, which we figured you’d want to see in its entirety. Imagine a jury getting to hear this stuff.

DECLARATION OF JANE DOE #1

I, Jane Doe #1, declare as follows:

1. I am over the age of eighteen (18). I have personal knowledge of the facts stated below and, if called upon to do so, could and would competently testify thereto.

2. I am a Plaintiff in the case of Bixler, et al. v. Church of Scientology International, Inc., et al.

4. I was raised in Scientology by my parents and became a member of the Sea Org when I was 17 years old.

5. I met Daniel Masterson in 1999-2000 as he was acquainted with my father. My close friend, Brie Shaffer, was employed as Masterson’s personal assistant.

6. I would see Masterson often at social gatherings due to our mutual friends, but we were not friends.

7. At these social gatherings, Masterson would make sexual advances towards me and then berated me for refusing his advances.

8. In September 2002, I was supposed to meet with a group that included Shaffer, Masterson, and others.

9. After I arrived, I learned that Shaffer was not coming.

10. I encountered Masterson, who had already purchased a drink for me and encouraged me to drink it.

11. After I finished the drink, Masterson immediately ordered another drink for me.

12. As I began to consume the second drink, I felt the effects of the alcohol.

13. The effects felt were greater than I expected after having consumed similar amounts of alcohol in the past.

14. I was supposed to stay at Shaffer’s house but due to her absence, Shaffer had arranged for me to stay in Masterson’s guest room.

15. I realized that I was intoxicated and went to bed alone in the guest room.

16. I awoke to Masterson having sex with me.

17. I was intoxicated to the extent I could not consent to this sexual encounter.

18. I was confused, disoriented, scared, and intoxicated to the point where I could not defend myself or resist.

19. Eventually, I was able to push Masterson off of me.

20. I did not want to have sex with Masterson and did not consent to any sexual encounter.

21. I tried to avoid being alone with Masterson.

22. On or about April 24-25, 2003, I was present at Masterson’s home along with multiple other people. Most people were in Masterson’s backyard drinking and using a Jacuzzi tub.

23. Masterson made me a drink, and as I drank it I began to feel very sick and disoriented.

24. I became far more intoxicated than I had been previously when drinking the same amount of alcohol. I thought that I must have been drugged.

25. Masterson forcefully pulled me out of the chair I was sitting in and pushed me into the Jacuzzi tub.

26. When I got out of the Jacuzzi tub, I began to feel worse. I could not open my eyes and was having difficulty breathing.

27. Masterson said he would take me inside to throw up. I said I did not want to go with him and his close friend, Luke Watson, said he would take care of me.

28. Watson is the son of Susan Watson, President of Defendant Celebrity Centre International. Masterson insisted that he take me and proceeded to pick me up.

29. I protested as Masterson tried to carry me upstairs.

30. I was disoriented and unable to stand on my own. Masterson put me in front of the toilet and stuck his fingers down my throat to induce vomiting. He then undressed me and put me in the shower where he handled me very aggressively and sexually assaulted me. I was intermittently unconscious. Masterson then dragged me from the shower and threw me onto his bed where I passed out.

31. I awoke to Defendant Masterson raping me. I attempted to fight him off by shoving a pillow into his face, but he pushed it back down onto my face, making it difficult for me to breathe. Masterson also used his hands to strangle me until I lost consciousness.

32. During the rape, when I heard noise coming from the other side of the bedroom door, Masterson told me not to say a word and reached into a drawer and picked up a gun.

33. Defendant Masterson then held me down and anally assaulted me. Masterson only stopped when he heard a voice at the bedroom door and went to investigate.

34. I recall at one point, I escaped from the bedroom and returned downstairs. I recall Defendant Masterson and Watson grabbing me and bringing me back up to Masterson’s bedroom.

35. I recall crawling into the bedroom closet and passing out. I woke up the next morning naked and hiding in the closet.

36. Masterson’s sexual assault was reported to Defendant Church of Scientology Celebrity Center International by someone other than me.

37. My friend D.P. later told me that he saw Masterson push me into the jacuzzi and then take me upstairs. He said that he saw me approximately about an hour and a half later when I came up to him with wet hair and bare feet and said, “Oh my God Danny just raped me.” D.P. also observed Masterson and Watson trying to get me back upstairs.

38. D.P., who was a Scientologist at the time, also told me that he was called into the Church of Scientology Celebrity Centre within days of the sexual assault. He was confronted by an agent of Defendants, CCI Ethics Officer Miranda Scoggins, and told “in no uncertain terms” that Masterson “had not done anything” to me. He was told that I was “doing ethics handlings” to help me. D.P., tried to do as he was told but would remain haunted by what he saw for years until he became the connection between me and Plaintiff Bixler.

39. In May of 2003, I reported Masterson’s assault to my Ethics Officer, Julian Swartz.

40. Swartz is an Ethics Officer to many celebrities and other prominent Scientologists and as a result he consistently communicates with the highest levels of Defendant CSI.

41. I reported to Swartz what I recalled at the time about what Masterson had done. I also reported that I had told a friend, Swartz instructed me to go back to my friend and tell him what I said about Masterson was not true and that I was joking. Swartz also told me not to speak about it to anyone and that it would be handled internally within Scientology. I attempted to explain to Swarts that what happened was rape. This infuriated Swartz who insisted that this was not rape and that I was “not to use the ‘R’ word again.”

42. Defendant CSI required me to begin an ethics program that Swartz designed. It required that I report to him daily and get his permission to travel. It required me to read many policies, including those policies that state it is a “high crime” to report anything criminal or negative about another Scientologist, policies regarding disconnection, policies regarding how one becomes declared Suppressive Person, and policies that describe what happens to Suppressive Persons. Swartz consistently reminded me not to talk about the sexual assault and repeatedly told me that high ranking officials within CSI were aware of my ethics programming and monitoring it closely.

43. The ethics program designed by Swartz also included frequent and hours-long auditing sessions in which I was repeatedly asked to admit to “past crimes” that I allegedly committed during previous lifetimes. I was pressured into “confessing” to “evil purposes” I had toward Miscavige, Scientology, L. Ron Hubbard, and others.

44. In July 2003, I encountered Watson, who admitted that he reported the sexual assault directly to Defendant Miscavige.

45. In December of 2003, the Institutional Defendants and/or Defendant Masterson discovered that I had told friends and family about the sexual assault. I was first ordered to meet with Miranda Scoggins and then Swartz. I was handed a “non-enturbulation order,” a formal censure that precedes a Scientologist being declared a suppressive person. I was told that if I continued to talk about the assault, I would instantly be declared a suppressive person and would be subject to Fair Game.

46. In January 2004, I was made to undergo “security checks” or “sec checks” which are used by the Institutional Defendants and/or Defendant Masterson as a form of investigation. I was subjected to intense auditing that included reading reports written about the sexual assault, including those written by Watson and Masterson. Defendant Masterson’s report included admissions about the sexual assault. Despite Defendant Masterson’s and Watson’s admissions, the Institutional Defendants and Defendant Miscavige never took negative action against Defendant Masterson.

47. At the conclusion of this “sec check,” I was forced to sit in a room alone with Masterson, the man who sexually assaulted me, at the direction of the Institutional Defendants and/or Defendant Masterson so that we could “clear the air.”

48. In January 2004, my mother, who is a Scientologist, wrote a letter to Tammy Wilkoff, an official with Defendant RTC. In it, she detailed the sexual assaults committed against me and the woefully inadequate response from the Institutional Defendants. She detailed a number of disturbing reports written about the assault and how Defendants CSI and/or CCI was failing to address it. She also wrote that she believed the non-enturbulation order entered against me was intended to suppress information related to my assault from being made known. She also related that she learned Shaffer had written a report concerning the sexual assault to the Institutional Defendants the day after it occurred.

49. In March 2004, frustrated with the lack of progress after her January 2004 letter, my mother wrote another letter, this time directly to Defendant Miscavige. She attached her January 2004 letter and demanded that Miscavige act. She detailed admissions by Masterson and Watson, as well as inconsistencies in their account of what had occurred.

50. In response to these letters the non-enturbulation order against me was lifted and I was given free auditing by the Institutional Defendants.

51. I received a letter on April 21, 2004, from Defendant CSI International Justice Chief Mike Ellis reminding me of the written policy in Scientology that it is a “Suppressive Act” to report a fellow Scientologist in good standing to civil authorities.

52. On June 6, 2004, despite more than a year of institutional Defendants and their agents trying to convince me to not report that I was not raped, included convincing D.P., a critical witness to a criminal prosecution, that nothing wrong or criminal had occurred. I reported the sexual assault to the Los Angeles Police Department. The Institutional Defendants and Defendant Masterson mobilized against me to ensure no charges were filed.

53. Charges against Masterson were not filed.

54. After my report to LAPD, Kendrick Moxon, a partner from Moxon and Bowles, the law firm that represents the interests of the Institutional Defendants and its affiliate organizations, arrived at my parents’ home and met with my father. Moxon handed me a letter instructed me to step outside and read it while he had a private conversation with my father. Moxon was acting as an agent of the Institutional Defendants and/or Masterson. The attorney carried with him a letter, written by Defendant Masterson, where he stated words to the effect of “if you got hurt, sorry you got hurt.” I was astonished that this is how Masterson attempted to apologize for raping me. I was told that I was not allowed to keep the letter. Moxon advised my father that Swartz would be contacting me to broker a meeting between me and an attorney for Masterson, which Swartz did.

55. Ultimately, I was instructed to go to Singer’s office where I was presented a document to sign. Singer was acting as an agent of Masterson and/or the Institutional Defendants. I was told that unless I signed a non-disclosure agreement that included Masterson and the Institutional Defendants, that I would be declared a SP and my family would be forced to disconnect from me. As a result, and with no other choice, I signed the document that was put to me. I was not given a copy of the document.

56. In or around June 2005, I was told by someone I knew to be a Scientologist that I had been declared. I was shocked since I had signed the non-disclosure agreement, albeit under duress and coercion, and believed that I would not be declared as a result of signing the non-disclosure agreement.

57. Around the Father’s Day 2005, I arrived in Florida with my family and attempted to enter Scientologist Flag Land Base, and I was informed that I was not allowed to enter the Org because I had been declared. Despite protestations from my family I was refused entry onto the Org because I had been declared a SP. I left Florida and returned to California.

58. In 2016, I learned that Plaintiff Bixler was seeking to contact me. I connected with Plaintiff Bixler and eventually confided that I had been assaulted by Masterson. Subsequently, I was contacted in December 2016 by the Los Angeles Police Department regarding my previously reported sexual assault.

59. As a result of reporting my sexual assault to the police, I was declared a “suppressive person” by the Institutional Defendants and/or Masterson.

60. After I was contacted by the police in 2016, Defendants carried out an intense fair game campaign against me. Thereafter, as previously threatened, Defendants launched a campaign of harassment, surveillance, and abuse against me and my family which continues today.

61. Upon information and belief, all the following-described acts of harassment, surveillance, and/or stalking were carried out by or at the direction of Defendants’ employees, agents, and/or representatives.

62. From late 2016 to present, I have received hundreds of phone calls and texts messages from unknown numbers.

63. On one occasion in 2018, I answered my phone and a man’s voice asked if I was “scared” before the call was quickly terminated. This call came from a number with a New York area code that repeatedly called my phone number. I reported this latest incident to the LAPD and was advised detective with the LAPD called the number; I never received a phone call from that New York number again.

64. In November of 2016, I was followed and surveilled by Defendants’ agent Michelle Miskovich. Miskovich followed me to a Best Buy and proceeded to follow me into the store. After this instance, Miskovich contacted a reporter to claim that I and other Plaintiffs were fabricating our claims against Masterson. Several months later, Miskovich contacted B.S., a witness to my sexual assault, in an attempt to dissuade B.S. from speaking with police.

65. Defendants had others attempt to dissuade B.S. from telling the truth. For instance, Vanessa Mooney, who told B.S. that I was fabricating my claims against Masterson.

66. I was contacted by Masterson’s publicist, Jenni Weinman, after Weinman contacted Plaintiff Bixler. Weinman is an agent of Defendant Masterson. Weinman pretended not to know me despite the fact that we met previously, socialized together, and I was present with her on one of the occasions that I was sexually assaulted by Masterson. I was advised by Plaintiff Bixler that Weinman told Plaintiff Bixler that she knew me. Weinman attempted to gather information from me about the sexual assaults committed by Masterson against me. Weinman also encouraged me not to pursue my allegations any further.

67. I observed an SUV sitting outside of my home on many occasions for long periods of time. I observed the driver of the SUV, an agents of Defendants, photographing me with his cell phone.

68. In March of 2017, a blog was posted online publicly revealing the existence of an LAPD investigation into Defendant Masterson as a result of the reports of sexual abuse.

69. In March or April 2017, I was followed by Shaffer, Masterson’s one-time personal assistant, throughout Larchmont Village for approximately twenty minutes.

70. In March and April of 2017, my mother, a Scientologist, had frequent phone contact with me. In one call she told me that I was already under surveillance. She later told me that I should be prepared to be followed and have my trash taken. My mother repeatedly told me, through at least 2019, that I should “keep my trash clean.” My trash has in fact been frequently stolen and I repeatedly observed people following me on many occasions. When I complained via text about being stalked, harassed, followed, and having my trash taken, my mother suggested that Defendant Masterson and/or his associates were responsible.

71. Around this time, my mother advised me to “leave the past in the past,” warned me not to end up like my father (who passed away years earlier), and warned me against getting trapped into scorching the earth and that it would only lead to my death and sorrow.

72. My mother has been provided legal counsel by the Institutional Defendants for purposes of the criminal investigation. My mother has not been fully cooperative with law enforcement. Furthermore, I was told by Scott Ross, a private investigator for Defendant Masterson’s attorney Thomas Mesereau, that any Scientologist he wishes to speak to must be contacted through attorneys for the Church, whether they are represented by those attorneys or not.

73. I retained an attorney to attempt to obtain a copy of the non-disclosure agreement I signed under duress and coercion. That attorney contacted Marty Singer, who still represents Defendant Masterson. Singer informed my counsel that I was violating the terms of the agreement and that I could not have a copy as “only the lawyers” got copies if they also entered into a million-dollar non-disclosure agreement. My attorney refused.

74. In March of 2017, I observed my card doors open and found that my car was broken into in front of my home and a debit card was stolen. The account linked to those cards was then over-drafted in the middle of the night.

75. On many occasions, I observed my trash being dumped into the back of a vehicle.

76. In April of 2017, I noticed I was frequently being followed.

77. In 2018, I frequently awoke to find my car door(s) open.

78. Beginning in March 2018, I observed people frequently parked outside my family home for hours and looking into my windows. On one occasion, I confronted an agent of the Defendants, a woman who was surveilling my home. The woman wore all black and baggy clothes including a hoodie. Beginning in May 2018, the woman would stand outside the curtilage of my home after midnight and stare at the property. The woman also rifled through my trash. On certain evenings, the woman used a flashlight and pointed the beam into various windows of the home including my children’s bedrooms. The woman also followed me in public during the day including to my hair salon. I contacted LAPD who ultimately identified the woman and approached her in the vicinity of my residence. at that time the woman provided a fake name to LAPD. During the summer of 2018, I went on an extended vacation and was advised that the woman no longer stood outside my house. When I returned, so did the woman. LAPD then confronted the woman at her own residence. The woman continued to return to my home where she made obscene gestures in the direction of my home and continued to flash a beam at and inside my home.

79. In and around September of 2018, Defendants’ agent Kathy Gold started publicly threatening Masterson’s victims, including me. Her blog on WordPress stated that she would kill them and claim self-defense. I sent the blog post to the LAPD. A true and correct copy of one of Gold’s threats against me and other Plaintiffs is attached as Exhibit A.

80. In January of 2019, I was at an appointment with an accountant. When I left the appointment and was walking to my car, I was accosted by two agents of the Defendants, a male and a female. They were yelling at me and threatening my life. The male spat on my windshield as I fled the parking lot. I later found out that a major tenant who shares the building with my accountant is a company run by a Scientologist. I was able to use the company website to identify the two individuals that accosted me and threatened my life. Both are Scientologists. In addition, one of the individuals that works at the company is a friend of Masterson and gave a statement in favor of Masterson during the course of the criminal investigation.

81. In February of 2019, I was followed into and around a grocery store by a man in a Sea Org uniform. Thirty minutes later when I got into my car the maps application on my phone suggested that I drive to an address around the corner from my home. This continued to occur for the following several months.

82. In March of 2019, I observed that the home adjacent to the rear of my property trimmed back a tree that had secluded my home, leaving my home visible to the neighboring property. Around this time, my cell phone map application would frequently malfunction and redirect me to that neighboring property instead of my own home. Additionally, my husband observed a man in our backyard. When my husband confronted him, the man fled back to the neighboring property. I later discovered that the property is owned by Scientologists, and their son, a Sea Org member, resides at that property.

83. Starting in March 2019, immediately after the man described in preceding paragraph was on my property, a tree that partially obstructed the view of my home from the neighboring property began to die. In April 2019 I consulted with a gardener who informed me the tree had been poisoned at the root. In June 2019, it was confirmed that the tree was poisoned and the dead portions of the tree were cut down. My property can now easily be seen from my neighbor’s property, the home owned and occupied by Scientologists.

84. There have been three occasions when I was in a specific hardware store when I was followed by different men in Sea Org uniforms. On one of these occasions, the man photographed me in the store.

85. I have also experienced various acts of fraud committed against me including prescription fraud.

86. On multiple occasions, agents of Defendants have approached my residence pretending to be solicitors and have made efforts to gain access to my home.

87. I also experienced a host of issues with technology outside of that detailed above including but not limited to having my cellular devices connect to other devices that I do not own and have never heard of as well as hearing voices, noises, and other interference in the background of phone calls made from my cellular devices.

88. In August 2021, an investigator with the Los Angeles District Attorney’s, first name “Lou,” came to my home to evaluate my home security and electronic devises and advised that our home and our devises had been compromised and gave me specific instructions on how to lock down our home security and devises.

89. To this day, I continue to be threatened, harassed, stalked, and surveilled.

90. In or around June 2023, shortly after Defendant Masterson was convicted, a known agent of Scientology tweeted about me and the other Plaintiffs:

Because those 3 women implied drug use by Masterson, every Scientologist in LA now knows they were lying. Scientologist just don’t use drugs. Every Scientologist who recognizes these women will spit on them, for the rest of their lives. I sure wouldn’t want to be them.

91. Later that day, the same known agent of Scientology tweeted:

Since these women live in LA and there are thousands of Scientologists in every walk of life in LA, the three women who lied in the Danny Masterson case will get spit on a lot. I don’t think they will take it out on the jury or judge since these were just fooled and manipulated by a false “expert witness.” But the 4 women will live in hell, now and for the rest of their lives.

A true and correct copy of this tweet is attached hereto as Exhibit C.

92. These actions described above were committed by Defendants, their agents, employees and/or representatives.

93. The Corporate Defendants did not report the abuse to any governmental authorities, nor did they take any other action to protect women from future harm by Defendant Masterson.

94. Thereafter, as previously threatened, Defendants launched a campaign of harassment, surveillance, and abuse against me and my family which continues today.

95. As a result of the foregoing, I continue to be in fear for my life and the safety of my family. I am always looking over my shoulder and worried that someone is following me or will harass me. I am very worried for my children’s safety and well-being. I have difficulty sleeping. I am always anxious. I have two service dogs who provide me a sense of security and alert me and assist me when I have a panic attack. I have been prescribed anti-anxiety medications. The simplest things can cause me extreme fear — a car driving by or a person walking up behind me on a street. I do not feel safe.

I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.

Actress Tricia Vessey and civil RICO added to Scientology lawsuit in proposed new complaint

[Actress Tricia Vessey joins the ‘Bixler’ lawsuit against Scientology and Danny Masterson]

We’ve been telling you for several weeks that a new amended complaint was expected in the Bixler v. Scientology lawsuit, and that it might dramatically change the case.

That’s the lawsuit that was filed by Danny Masterson’s victims in 2019, even before he was charged criminally in June 2020. And the lawsuit initially wasn’t about the sexual assault allegations, it was about the harassment that the women said they were experiencing since they had come forward to the LAPD in late 2016.

The lawsuit suffered a setback when it was forced into Scientology “religious arbitration,” but then an appeals court overturned that decision. Then the lawsuit was put on hold while Masterson’s criminal trials were happening. In the meantime, the Jane Does suing Scientology replaced their lawyers. And now that Masterson has been sentenced to 30 years to life in prison, the lawsuit is active again, and attorneys for both sides said they expected to see this new complaint (technically the “second amended complaint” in the case).

Yesterday, the plaintiffs filed a proposed copy of their new complaint with the court, and it contains some surprises.

First, a sixth plaintiff, actress Tricia Vessey, is joining the case to sue Scientology. She testified in Masterson’s first criminal trial, alleging that he had raped her in 1996 after a wrap party in his Hollywood home. (The other five plaintiffs are Jane Doe 1, Jane Doe 2, and Chrissie Carnell-Bixler from the criminal trials; Chrissie’s husband Cedric Bixler-Zavala; and Bobette Riales, another woman who alleges that Masterson attacked her, but who was not a part of the two trials.)

Second, the plaintiffs have added civil RICO charges to the lawsuit, accusing Scientology of racketeering and of being a criminal enterprise.

Also, the lawsuit is now very much about the sexual assaults and not just the harassment, with multiple plaintiffs suing Masterson for attacking them and Scientology for covering it up.

Wow, there’s a lot of new stuff here and some surprising revelations. But we mostly wanted to show you the change in language, with attorneys for the Jane Does referring to Scientology as a “criminal enterprise” throughout.

This is a lengthy document, but we want to show you the actual language from its introduction, to give you a sense of how it has changed the approach of this case.

Chrissie Carnell Bixler, Cedric Bixler-Zavala, Jane Doe #1, Bobette Riales, Jane Doe #2, and Tricia Vessey hereby allege against The Church of Scientology International, Religious Technology Center, and Church of Scientology Celebrity Centre International (collectively, the “Corporate Defendants”); and David Miscavige, Daniel Masterson, and DOES 1–25 (collectively, the “Individual Defendants”) as follows:
INTRODUCTION
1. The Defendants are members of a criminal enterprise within Scientology. That criminal enterprise includes many individuals, including the Individual Defendants, and a number of corporate entities, including the Corporate Defendants.
2. Defendant David Miscavige is the undisputed and unquestioned leader of this criminal enterprise and derives significant financial benefit from Scientology’s criminal and unlawful activity.
3. Scientology was devised by L. Ron Hubbard, a science-fiction author who was dissatisfied with the income that vocation provided him. As his wife explained, Hubbard believed that “‘[t]he only way to make any real money was to have religion.’ That’s essentially what he [Hubbard] was trying to do . . . Get a religion where he could have an income and the government wouldn’t take it away from him in the form of taxes.” A science-fiction associate of Hubbard’s similarly recounted that Hubbard believed “the only way to make a million dollars was to form your own religion.”
4. Scientology’s self-described governing philosophy is “MAKE MONEY. MAKE MORE MONEY. MAKE OTHER PEOPLE PRODUCE SO AS TO MAKE MORE MONEY.”
5. Many of Scientology’s criminal enterprise’s money-making schemes are criminal in nature; it routinely and systematically engages in fraud, human trafficking, identify theft, and money laundering to fill its coffers and enrich its leadership.
6. Scientology’s criminal enterprise also makes money by selling pseudo-scientific “auditing sessions.” Scientology’s criminal enterprise claims these sessions “bring people from a condition of spiritual blindness to spiritual existence” and that they cure arthritis, dermatitis, asthma, coronary difficulties, eye trouble, bursitis, ulcers, sinusitis, cancer, and any number of other physical ailments. As befits such lofty (purported) results, customers who purchase the entire course of auditing sessions spend upwards of $500,000.
7. As with many criminal enterprises, Scientology’s takes steps to protect itself and its co-conspirators from governmental authorities. Scientology’s criminal enterprise takes a two-faced approach to protecting its criminal activities: it simultaneously presents an innocuous front to the public while terrorizing any who speak out about its unlawful activity in order to intimidate them and dissuade them from seeking protection from law enforcement or from cooperating with governmental authorities.

8. In order to provide itself with a patina of legitimacy, Scientology’s criminal enterprise recruits celebrities to serve as its public ambassadors. Defendant Daniel Masterson is one such celebrity. During Masterson’s long association with Scientology, Scientology’s criminal enterprise used its resources to assist Masterson with his burgeoning acting career and provided him preferential treatment within Scientology. In exchange, Masterson publicly supported Scientology and its criminal enterprise (by, for example, claiming Scientology cures depression).
9. While presenting itself outwardly as a respectable organization, Scientology’s criminal enterprise has implemented a policy of terrorizing victims (and witnesses) of its crimes — whether or not those victims (or witnesses) are Scientologists — into keeping Scientology’s crimes secret. This begins by inculcating its members to distrust outsiders, and particularly to distrust governmental enforcement. Scientology’s criminal enterprise has a strict policy against reporting crimes to the authorities, and if a member does find the courage to go to the authorities, Scientology’s criminal enterprise and its agents engage in a coordinated effort to wreak havoc on the victim’s life through a targeted harassment campaign. These harassment campaigns extend to non-members as well, who are frequently targeted for harassment if Scientology’s criminal enterprise sees them as a threat.
10. Scientology’s criminal enterprise’s harassment campaigns are carried out by Scientologists within that enterprise. But Scientology’s criminal enterprise also uses its significant resources — including the proceeds of its criminal endeavors — to hire outside agents (i.e., non-Scientologists) to implement and carry out its harassment campaigns.
11. Prior to the events alleged herein, Scientology had known for years that Defendant Masterson had raped and sexually assaulted multiple women. In order to protect Defendant Masterson, and to protect itself, Scientology’s criminal enterprise chose to bury knowledge of Defendant Masterson’s crimes.
12. While Scientology knew that Defendant Masterson was a rapist, due to Scientology’s criminal enterprise’s concealment of that fact, Plaintiffs Bixler, Riales, Vessey, and Jane Does 1 and 2 did not. Over the course of the late 1990s and early 2000s, each of them associated with Defendant Masterson in different capacities, and Defendant Masterson assaulted and raped each of them. For years, Plaintiffs Bixler, Riales, Vessey, and Jane Does 1 and 2 believed themselves to be Defendant Masterson’s only victims and, due to fear of reprisal from Scientology and its criminal enterprise, did not report Defendant Masterson’s rapes and sexual assaults to the authorities.
13. Beginning in 2016, Plaintiffs Bixler, Riales, Vessey, and Jane Does 1 and 2 began to contact each other and came to understand that Defendant Masterson was a serial rapist. In the hopes of preventing him from continuing to prey on women, they went to the authorities to report his sexual assaults.
14. As soon as Plaintiffs went to the authorities, Defendants began a concerted, targeted campaign of harassment and intimidation aimed at preventing Plaintiffs from cooperating with the authorities.
15. On June 16, 2020, Defendant Masterson was charged with forcibly raping Jane Does 1 and 2 and Plaintiff Bixler.
16. Defendants redoubled their efforts and began to harass both potential witnesses to Defendants’ illicit acts and at least one of the prosecutors assigned to Defendant Masterson’s criminal trial.
17. Defendants’ efforts failed again to stop Defendant Masterson’s prosecution. On May 31, 2023, a jury convicted Defendant Masterson of forcibly raping Jane Does 1 and 2 and hung on the count of forcibly raping Plaintiff Bixler, with eight of twelve jurors voting to convict. On September 7, 2023, Defendant Masterson was sentenced to imprisonment for a period of 30 years to life.

The lawsuit then dives into the background about how Scientology operates, and how it targets its perceived enemies with its “Fair Game” retaliation methods.

As for Masterson, there’s a new allegation now listed in the lawsuit:

“In 1994, Defendant Masterson raped and sexually assaulted a 15-year-old girl (‘V1’). V1 was a Scientologist and immediately reported the rape to Defendants’ agents. Defendants did not go to the authorities and instead concealed the rape to protect Scientology and Defendant Masterson.”

(In 1994, Masterson turned 18 years old.)

“In 1996, Defendant Masterson raped and sexually assaulted a Scientologist (‘V2’). V2 also reported the rape to Defendants’ agents. Once again, Defendants did not go
to the authorities and instead concealed the rape to protect Scientology and Defendant Masterson.”

That second victim could not have been Tricia Vessey, who also reported being raped in 1996, because Vessey was never a Scientologist. So that’s three alleged rapes by 1996 that the plaintiffs are accusing Scientology of covering up and preventing the victims from knowing about each other.

The lawsuit then goes into minute detail about the allegations of stalking, hacking, intimidation and harassment by the individual plaintiffs, some of which is repeated from earlier versions of the case.

For Carnell-Bixler and Bixler-Zavala, for example, there was the horrific poisoning of their dog by someone who had tossed rat poison placed inside raw hamburger into their yard, clearly an intentional act.

Riales, who lives in Indiana, alleges that anonymous callers claimed she was abusing her children to the state department of child services. “These allegations were false, but nonetheless resulted in a lengthy investigation of Riales. After numerous court hearings, no adverse action was taken against Riales.” (Longtime readers will remember that both the Headleys and Jason Beghe were subjected to this same harassing tactic.)

Bobette’s dog was also poisoned, but survived, and she was in her home one day when she found that the outside of it had been set on fire, and the local fire department said it had been intentionally set.

The women allege that their phones and home security systems have been repeatedly tampered with, their emails erased, even their prescriptions interfered with. All of it, they believe, was carried out by the defendants.

And now, the list of charges has grown quite a bit:

What a huge change this is from the previous complaint, and no doubt we’ll be hearing a howl of protest from Scientology’s attorneys very soon.

Continuing our year in review: The stories of August 2023

We started off the month with some personal news: We’d be going under the knife in August, which would prevent us from going to Los Angeles for Danny Masterson’s sentencing. But that all turned out fine and we’re cancer-free and hoping it stays that way.

The next day, Leah Remini filed her lawsuit against the Church of Scientology and its leader David Miscavige over the “Fair Game” retaliation she has been enduring for years. Her specific allegations about the way Scientology’s harassment has harmed her business projects seems to make this a particularly troublesome suit for the church.

Judge Charlaine Olmedo ruled that all three Jane Doe victims would be allowed to give statements at Masterson’s sentencing, even though he was convicted on only two of the counts.

Sinéad O’Connor’s death elicited a fascinating remembrance from one of our readers about how the Irish singer had dated a Scientologist but managed to keep away from the organization itself, something O’Connor herself confirmed in her writings.

An odd twist in the Leah Remini lawsuit: Leah asked for a new judge, but then the next one chosen had to recuse herself because her attorney husband has done work for the church. Small world.

Sands Hall updated us on her latest adventures at our podcast.

We just had to thumb our nose at the Daily Mail and its speculation about Tom Cruise leaving Scientology after it was picked up by the rest of the tabloid horde as gospel.

After Jane Does make calm legal response, Scientology attorneys are angry — real angry

We told you a week ago that what really struck us about the court filing made on behalf of Danny Masterson’s victims regarding the Church of Scientology’s attempt to gut their lawsuit was how calm and logical it appeared, in distinct contrast to the way Scientology’s court briefs tend to be screechy and petty sounding.

Well, Scientology’s attorneys William Forman and Matthew Hinks have filed their reply, and this time they’re really swinging for the fences.

We wondered if the calm way that the lawyers for the Jane Does had responded to Scientology’s motion to strike might set them off, and boy, that seems to be the case.

We’ll just quote here at length the opening to give you a sense of how teed off these guys seem to be.

Plaintiffs’ Opposition reveals there is no mystery about what is really happening here. Plaintiffs would rather try allegations of rape than allegations of rummaging in garbage cans; they would rather cherry-pick and misinterpret the writings of L. Ron Hubbard than offer proof that the Church Defendants did anything to Plaintiffs. But Plaintiffs’ attempt for prejudice should not work.

The Opposition itself shows that the Motion must be granted. Plaintiffs admit that all of their claims are not “based on” the allegations to be stricken and that such allegations are not necessary to proving their claims. Therefore, under unambiguous law, the allegations are immaterial and should be stricken; no other grounds are needed.
But there are more grounds requiring granting of the Motion. The Motion showed that the only reason Plaintiffs are before this Court – and not in religious arbitration – is that, at Plaintiffs’ urging, the Court of Appeals subscribed to a narrow construction of their claims that excluded conduct while Plaintiffs were Scientology parishioners and would not call for “resolution of ecclesiastical issues.” Plaintiffs try to escape the application of Bixler by asserting that Plaintiff Riales was not part of the Bixler appeal. That argument helps neither the other Plaintiffs nor Riales herself, who never attempts to show why the allegations to be stricken are material as to her. Plaintiffs also try to avoid Bixler by pretending that a decision made by this Court prior to Bixler is controlling, effectively ignoring Bixler as law of the case. Having baited the Bixler Court, Plaintiffs cannot now wriggle off Bixler’s hook.

Are you getting how angry the Scientology side still is about that appellate ruling in January 2022 that restored the Bixler lawsuit? Yeah, it’s palpable.

What they’re screeching about is that after this lawsuit was originally filed in 2019, its first judge granted Scientology’s motion to force it out of court and into Scientology’s trap, otherwise known as “religious arbitration.” But then an appeals court ruled that it was unfair for these former Scientologists (the Jane Does) to have to abide by contracts they signed while they were members of Scientology when the harm they were alleging — the stalking, hacking, even the poisoning of their pets — was happening years after they had left the church.

Scientology (or rather, its boss David Miscavige, who is the real person Forman and Hinks are writing for) is still steaming angry that this happened, and that this lawsuit escaped their trap.

Now, they’re hopping mad that the attorneys for the Jane Does, John Kucera and Seth Lehrman, submitted such a well written and calm response to their motion to strike. The nerve!

But OK, we’re just commenting here on the style of these filings. What about the substance? What’s at stake here is that Scientology is asking the court to remove large sections of a 2020 first amended complaint, saying that they are either irrelevant or that they have to do with Scientology’s internal policies, which shouldn’t be subject to litigation.

Kucera and Lehrman argued that the material Scientology said was irrelevant was actually important to the case, as it showed why the Jane Does had felt they couldn’t come forward with their rape allegations against Danny Masterson earlier, and in order to do that it is necessary to quote Scientology’s internal policies.

Now, in their reply, Scientology’s attorneys are arguing that this misstates the law, and that the Jane Does’ attorneys are cretins and they pick their teeth at the table, or something.

What will Judge Upinder Kalra think about all this sniping back and forth? We’ll find out next week at a hearing on Wednesday. The last time this matter was before him, Judge Kalra seemed pretty level-headed and indicated that he wasn’t going to put up with any nonsense. Will he appreciate the bellyaching by Forman and Hinks? We wonder.

1999 A French court this week handed down guilty verdicts and sentences for Marseilles Scientologists now convicted of fraud. From Reuters: “A French court on Monday jailed a former leader of the Church of Scientology for six months, with a further 18 months suspended, for fraud. Xavier Delamare, an ex-leader of the church in southeastern France, was also fined 100,000 francs ($15,750). Five other members of the church were given suspended sentences ranging from six months to a year. One of the defendants, who has turned against the group and accused Delamare of sending him on shady fundraising missions, was cleared. The seven Scientologists went on trial last September on charges of fraud, violence and illegally practising medicine in connection with courses in spiritual purification organised for church members. Delamare’s lawyer Jean-Yves Le Borgne said after the verdict that the proceedings had smacked of lynch law. The trial was marred by the disappearance of legal evidence, which authorities blamed on a court clerk’s mistake. Legal documents that could have been used as evidence against the movement in two other cases have also gone missing.”
