2000: Mark Bunker had a hearing this week in a criminal case based on his arrest out side the Chicago org by off-duty police officers. “I appeared before the judge for another pre-trial hearing over the charges leveled at me for pointing a camera at Scientology. Once again in attendance was Elliot Abelson and this time Sylvia Stanard was along from Washington D.C. I knew she would be there since I had dinner with the Zizic’s the night before and they told me she had come in to settle the Zizic’s claims and was pushing hard to make this happen fast. When we first heard from the Zizics, they were trying to get $20,000 back for courses they prepaid but never used. The cult stalled them for two years before the Zizics made a call to the LMT. From the time of their contact with the Trust, the Zizics were suddenly being offered that money back if they signed a waiver. Now, with my arrest and the possibility of sending me away for 10 – 25 years, the church is pushing even harder to settle with the Zizics, my only witnesses. Now the church is willing to give back all the money they defrauded from the Zizics. In this waiver they have to agree to shut up and not assist anyone with any litigation against Scientology whether as a plaintiff or as a defendant. The prosecutor was outraged by my appearing in Stamford at the Leo J. Ryan Conference and demanded once again that bail be raised and that I be restricted in my travel but the judge denied that motion allowing me to travel freely for my work. The prosecutor also said that they intend to treat this as a hate crime. If I truly hated Scientologists why would I give a warm smile and a wave to Sylvia when she entered the courtroom? The Zizics have assured me that they will be there when needed to testify on my behalf and I know they will. They are terrific people and it has been a pleasure getting to know them and their kids.”

— ‘Lafayette Ronald Hubbard’ (a/k/a Justin Craig), aggravated assault, plus drug charges: Grand jury indictments include charges from an assault while in custody. Pleaded guilty on Nov 10 to a 17-year prison sentence (eligible for parole in two to three more years). Awaiting transfer to state prison.
— Aaron Matthes charged for SA of child under 12 years old: OT Scientologist facing multiple mandatory life sentences. Next pretrial court hearing set for March 9.

— Leah Remini v. Scientology, alleging ‘Fair Game’ harassment and defamation: Some defamation claims were removed by Judge Hammock. Judge Hammock’s ruling is on appeal, which is now fully briefed. Awaiting the setting of an oral arguments hearing.
— Baxter, Baxter, and Paris v. Scientology, alleging labor trafficking: Forced to ‘religious arbitration.’
— Valerie Haney v. Scientology: Forced to ‘religious arbitration.’ 15 days of arbitration completed, Val waiting for further word from the IJC.
— Chrissie Bixler et al. v. Scientology and Danny Masterson. Judge Upindra Kalra’s ruling denying Scientology’s motion to strike is on appeal. Appeal fully briefed. Motion to replace Jane Does’ AI-tainted brief denied by court. Oral arguments hearing on March 3.
— Jane Doe 1 v. Scientology, David Miscavige, and Gavin Potter: Case unsealed and second amended complaint filed. Scientology moves for religious arbitration. Trial has been set for January 10, 2028.

1999: Focus reported on the activities of WISE companies in Germany. “Sibylle Kramer’s career developed in promising way. When her company changed ownership and she had to transfer to Hamburg in the same working capacity, she was happy to move to her new location. Her enthusiasm disappeared on the first work day. The new management’s customs seemed too peculiar to her. Every day at nine o’clock, the employees had to gather together for roll call to hear the slogan of the day shouted out as a battle cry, and the salespeople who had been recently successful were brought to the attention of the group and applauded. Laserplus, now incorporated under the same registered trade number as Eurozerty, is a member of the WISE (World Institute of Scientology Enterprises) business association, the most important money-making machine of the psycho-sect. The corporation (30 employees, 20 million marks in annual sales) also avails itself of an internet access which brings the visitor, after two mouseclicks, to Fort Harrison Avenue, Clearwater, Florida – the most important Scientology center in the USA next to Los Angeles. The Hamburg state Work Group on Scientology also had found that ‘something is going on the the computer area.’ The department director, Ursula Caberta, is concerned that Scientology companies could get into sensitive areas in other companies with their products. Scientologist Koenig has landed a big one with his acquisition of Eurozerty. ‘Only a few providers,’ he said to other trade representatives, ‘share this market in Europe.'”

1998: Michail Brzitwa reported that German TV aired a segment on Gabe Cazares, who led a German delegation through Clearwater, Florida. “There was a five minute report on how former Clearwater Mayor Gabe Cazares perceives the ongoing occupation of downtown Clearwater by the ‘Church of Scientology’. Mr. Cazares lead the reporters through parts of Clearwater where scientologists purchased very many premises through the last 20 years. The TV team and Mr. Cazares were followed closely all the time by scientology official Brian Anderson who, when asked, said he wanted to know everything that’s being said. Mr. Cazares mentioned the scientology secret service, the ‘Office of Special Affairs’, OSA. Then a short interview with attorney Ken Dandar and (I think) Dell Liebreich about the ongoing lawsuit against scientology concerning this suspicious incident.”

1997: Lars Westergren posted a transcript of a show on Scientology from BBC World. “Buildings like this aren’t cheap. Scientology founds itself by a doctrine of exchange. Members can pay thousands of dollars to complete all their courses, in payments that are called donations, but are in fact obligatory. Few churches prompt more antagonism than this one. A Greek judge has called scientology dangerous. The German government says that its financial demands can read to ruin and even suicide. But here in America, critics are more concerned with the Church of Scientology’s relentless bid, for public recognition. David Rodier is a professor of religion at American University. ‘They feel if you attack they attack in kind, and perhaps even more violently. And I think many people find this very threatening. New religions are by their very nature strange and odd, and we feel uncomfortable around them. And then when they, in addition to that, don’t behave according to our stereotypes the way religions should behave, then we _do_ get very uncomfortable.’ Sylvia Stanard: ‘The church has dealt with criticism, because we feel that people need to know what scientology is. And its also just – sociologically it is a very interesting phenomena that all new religions go through this. I mean, we’ve researched and gone through what they said about the Catholics in the 1700s, and all sorts of _wild_ accusations. I mean, the Mormons were killed. And that was a hundred years ago.'”

1996: An anonymous person this week posted the partially recovered contents of a floppy disk he found in Tampa. “important symbolic step towards Clearing the Planet, the Church of Scientology announced today it has obtained regulatory approval for a new satellite television network. Transmission is expected to begin in the the third quarter of 1996. The new satellite service, tentatively called KSWN (for ‘Keeping Scientology Working Network’), will broadcast Scientology and Dianetics news and technical programming 24 hours a day on two transponder channels. The second, scrambled, channel will consist of Scientology and Dianetics course material and training films, many of them produced by the late L.Ron Hubbard himself. Programming on the scrambled channel will be available to subscribers on a pay-per-view basis.

2002: Dave Bird reported a protest at the Birmingham, England org. “Just Dave, Jens, and John plus our sound system this time. The DSA appeared and wanted to tie us up talking to waste our time. Apparently they had done so well that week, they didn’t need to leaflet today. The true reason was apparent around 14:00, the Reg and her assistant had been leafleting the Palestine rally in the library square about 150 metres up the street from us. We finished after 2 hours dead and went to a pub just round the corner on the other side. The DSA and his side-kick followed us to the pub and stood across the road for twenty minutes then went away.” Christopher Wood reported a protest at the Toronto, Canada org. “Picketers: Me, Gregg Hagglund, Keith Henson, and The Unknown Picketer. Leaflets: We passed out approximately 500. My No Science/Scn Founder Con Man, Gregg’s Xenu/crimes, a couple of Kirsti Wachter’s ‘Scientology Hurts People,’ and some about the Children’s Sec Check. The picket went for about three hours. The Scientologists who do the picket handling stayed quiescent, so we managed to picket unmolested. I ran out of the 50 leaflets that I started out with. I ended up reading to one couple this paragraph from A History of Man, which clearly illustrates L. Ron Hubbard’s disturbing attitude towards the world: ‘This universe is a rough universe. It is a terrible and deadly universe. Only the strong survive it, only the ruthless can own it. Given one weak spot a being cannot long endure it for this universe will search it out and enlarge it and fester and probe it until that weak spot is a festering wound so large that the being is engulfed by his own sores.’ A group of three Scientologists came out the front door and Mario rushed over, saying ‘Go out the back! Go out the back!’ – and what do you know, they did as he said. A line of non-OT Scientologists, moving out the back door of the org, getting waved along by OT Scientologists, and serenaded by Gregg’s ‘Doubt is not a crime’ spiel. Gregg reports that the herdees appreciated this more than the herders. It seems fairly certain that we were followed home on the drive back. A white car stayed pretty close right from leaving the parking lot near the org.”

2001: La Prensa reported that Scientology’s ship, the Freewinds, may be inspected for dangerous asbestos levels. “People of the Shipping Inspection expect problems in seriously dealing with the ‘Freewinds’. All buildings and ships built before 1970 were built with asbestos. All plates/panels on roofs are made of dangerous asbestos. According to a functionary of the Shipping Inspection, this is a material which provides good protection from fire. ‘Why should we begin refusing ‘Freewinds,’ when we know that all ships built before 1970 were fitted with that material? Then we would have to refuse the majority of ships,’ according to the statement. Richardson emphasizes that blue asbestos is not dangerous, as long as one does not come into contact with it. ‘We understand that the asbestos on
board is in hard, and not powder, form. We will soon inspect the ‘Freewinds.’ We will do this together with Shipping Inspection and the Port Safety Inspection, since these are the the nautical authorities in this case,’ according to Richardson’s statement.”

2000: The Wall Street Journal published an article on Franchise Pictures and Battlefield Earth. “Big stars usually have to cut their fees by half or more, accepting instead profit-participation that in some cases reaches an enormous 40%, after costs have been recouped. Mr. Samaha’s strategy is just weeks away from its biggest test yet, the May 12 release of a science-fiction epic called ‘Battlefield Earth.’ The film is the pet project of John Travolta, whose superstar clout failed to get it made for a dozen years. Script problems and a projected $100 million budget were often blamed, but many movie executives thought another big factor was the film’s source materials 1982 novel by L. Ron Hubbard, late founder of the controversial Church of Scientology, which counts Mr. Travolta as a longtime member. ‘Battlefield’ is the first screen adaptation of any Hubbard science-fiction work, an achievement Mr. Travolta says is ‘like putting Tennessee Williams’ first works on the screen. It’s a big deal.’ Mr. Samaha, he adds, was ‘smart to trust the artist.’ ‘Everyone thought I was crazy or mentally retarded’ for tackling the project, Mr. Samaha says. Though the film has nothing to do with Scientology, some feared the Hubbard connection could provoke a backlash and make the film difficult to sell in places such as Germany and France, where Scientology has come under government attack. Even Mr. Travolta, Mr. Samaha recalls, warned that ‘lots of people are going to come to you and try and persuade you and be negative about it.’ Franchise got it made by using a formula usually reserved for tiny independent films. Imperial Bank in Los Angeles provided loans to pay the production costs, which were slashed to a planned $50 million, but about 80% of that was to be covered by the presale of foreign distribution rights. Mr. Travolta had been keen to make the project since the mid-1980s, when he first lent his name to screenplay adaptations of the 1,050-page L. Ron Hubbard novel. Mr. Elwes and others say that the Hubbard tie is the main reason ‘Battlefield’ has never been made. Asked if he believes that the Hubbard connection placed extra hurdles in the film’s way, Mr. Travolta says: ‘I’ll never know.’ He adds that, ‘If it were an issue secretly to someone, it would not be politically correct to voice it.’ The Scientology question was raised numerous times and batted down by Mr. Samaha, who says he would bark: ‘This is what the movie is about: It’s ‘Planet of the Apes’ starring John Travolta. You’re either in or you’re the f—— out.’ Intertainment President Barry Baeres says that, given the controversy over Scientology in Germany, ‘at first sight, you would say no to it.’ But he succumbed to Mr. Samaha’s insistence that ‘Battlefield Earth’ was Scientology-free. Mr. Travolta has contributed some of his own money – more than $5 million, according to Mr. Samaha.”

“PCs don’t return to auditors if the results are poor. So the Freezone is sort of self-qualifying. Auditors that are still in practice have to be good auditors. There are many auditors to choose from who have held their space. It could be compared to a free market, people go out of business when they sell faulty products.”

1999: Dennis Erlich posted a declaration filed in his copyright infringement case. “This declaration addresses the central feature Scientology practice which claims to provide a form of spiritual absolution and ascension through ‘confession,’ the maintenance of various files containing information
based upon these confessions by numerous Scientology entities, and the expectation of confidentiality associated with these confessional activities and files. [D]uring each auditing session, the auditor is required to maintain detailed notes on a worksheet which records the information discussed. These worksheets are placed into the person’s ‘preclear’ or ‘pc’ file. In my experience, preclears are indoctrinated to believe that confessions made or elicited during an auditing session are kept confidential. Despite this expectation, and in accordance with numerous Hubbard policies, after the session an auditor is required to report any
transgressions or breaches of Scientology’s numerous codes and policies in writing to the preclear’s ‘ethics’ file. Although most preclears do not know or understand this, an auditor is required to make special note of any potential ‘ethics’ matters that come up during an auditing session (for example, needle readings that indicate negative thoughts about L. Ron Hubbard or transgressions of policy) and report them to a Case Supervisor. When a Scientologist does an act or expresses a thought that might be considered to be counter to Hubbard’s intention, he or she can be placed in a ‘lower ethics condition.’ A Scientologist in a lower ethics condition is often ordered by an Ethics Officer, among other things, to go through a process called writing up ‘overts and withholds’ to help determine and
ameliorate the reason for the lower condition. The confessions made in an O/W write-up, while not formal auditing, are according to Scientology policy, considered to be ‘case actions’ to be filed in the confessional folder and considered to be confidential. A person cannot complete any action in Scientology or progress to the next action without writing a glowing ‘Success Story’ praising the gains they have made. Part of the graduation procedure from any level requires the parishioner to be sent to the Examiner who reads the Success Story and if it is glowing, puts the person on the e-meter and asks what is called the ‘Key Question,’ that is, ‘would you like others to have similar gains to yours?’ The person cannot ‘pass’ unless the e-meter needle ‘floats.’ If the person does not write a glowing success story, he is sent to the Department of Review for correction at his own expense. I would consider the information in my ‘ethics’ file to be confidential, and subject to the same privilege as material in my preclear file. It should also be noted that in discovery the plaintiff failed to turn over either my ethics files or my pc files, claiming that they had been lost. Instead what they produced were selected copies of discreditable materials culled from both folders. Although Mr. McShane acknowledged that Scientology considers material in a person’s preclear file to be confidential and privileged, it should be noted that Scientology considers that a person who has been declared a Suppressive such as myself is no longer entitled to such protection. Accordingly, as a matter of Scientology doctrine, plaintiffs would consider themselves to be entitled to use information culled from a confessional setting (during auditing or otherwise) to impeach or discredit a witness.”

1998: The St. Petersburg Times ran a story this week on Scientology’s growing attempts to influence Washington politics. “After years of holding the U.S. government in contempt, the Church of Scientology is enlisting members of Congress, the U.S. State Department and even President Clinton to advance its agenda in foreign lands. Prodded by the Scientologists’ paid lobbyists and its cadre of sympathetic entertainers, several lawmakers and the Clinton administration have criticized the German government for allegedly discriminating against Scientology practitioners. They even got their argument against Germany to the floor of the House of Representatives last November. The lobbying push comes amid an ongoing criminal investigation into a suspicious death of one of its parishioners at Scientology’s Clearwater headquarters – the latest in a history of controversy involving the church. That history includes convictions of 11 Scientologists on charges stemming from break-ins of government offices in the 1970s. Scientology has used lobbyists in Washington in the past, but in the years since the IRS ruling the organization has stepped up its lobbying effort. Records made public last week show that Religious Technology Center, a Scientology affiliate in Los Angeles, paid almost $725,000 to a Washington-based firm to lobby Congress in 1997 and 1996. David H. Miller, the managing partner of Federal Legislative Associates, said members of Congress initially were skeptical about his client and its checkered past. ‘What I’ve said to members is, ‘That’s all bulls—. That’s all extraneous. Let’s talk about the facts,’ he recalled, though he concedes: ‘What they are trying to do is live down some of their past mistakes.’ Miller, 50, is a former congressional aide who has been a lobbyist for 18 years. He and his firm represent clients such as the American Bankers Association and American Airlines. He is not, he said, a Scientologist. Miller, the lobbyist, said he has gradually tried to build a foundation of support that gives Scientologists’ claims of discrimination credence in Washington. The biggest victory in that regard has come from the U.S. State Department, which criticized the German government for its treatment of Scientologists in its annual human-rights report.”
