Just in: After soliciting briefs from both the prosecution and the defense, the California State Supreme Court has denied Danny Masterson’s petition to review a motion to dismiss his rape charges that was struck down in February.
In May 2021, a four-day preliminary hearing was held in the courtroom of Judge Charlaine Olmedo, which featured live testimony for the first time from the three women who allege that Masterson forcibly raped them in incidents between 2001 and 2003. At the end of that proceeding, Judge Olmedo said that she found the women credible and bound Masterson over for trial. She initially scheduled the trial for August 29, but yesterday it was moved back to October 11. If Masterson is found guilty of all three rapes at trial, he faces 45 years to life in prison.
Masterson then filed a “995” motion to dismiss Judge Olmedo’s ruling in another court, arguing that she had erred because she in part relied on interpretations of Scientology scripture. Masterson’s defense had actually brought the Scientology material into the case, an “ethics” book, and the prosecution had used it to show that the women might have come forward sooner, but they had been indoctrinated by Scientology that its rules prevented turning in a fellow Scientologist to “civil authorities.”
Masterson’s “995” motion was denied by Los Angeles Superior Court Judge Ronald Coen, so Masterson petitioned the state’s 2nd Appellate Division, asking for review, but that court turned him down flat.
He then petitioned the state supreme court, which then asked both sides for briefing on Masterson’s claim that his religious rights had been trampled by Judge Olmedo when she cited the Scientology ethics rules.
Today, the state supreme court indicated that it was denying his request for review.
The 995 motion was particularly interesting because Masterson was arguing that his religious rights as a Scientologist had been violated by Judge Olmedo because she had “interpreted” those Scientology scriptures. But the state supreme court apparently didn’t buy it. (Scientology itself was so angry it had tried to intervene, if you remember.)
So now, the only thing standing between Masterson and the October 11 criminal trial is one more motion to dismiss, in regards to just one of the victims, Jane Doe 1, which was heard yesterday but Judge Olmedo asked for more briefing from both sides and said she would rule on it by June 30.

1996: Scientology member Greta Van Sustern is in the news for ambulance chasing the families of the Valujet crash victims. From the Pensacola News Journal: “Relatives of Valujet crash victims in Atlanta reported last week that they were being contacted with offers by the law firm of CNN legal analyst Greta Van Sustern. The packet, which arrived in the mail, included pictures of Van Sustern, the commentator who made her mark as color analyst at the O.J. Simpson murder trial. The packet said Van Sustern’s team would represent the victims for free in exchange for 25 percent of any money recovered from the airline. Taking on such a case could cost $100,000, the packet warns.”
