ELEVENTH CIRCUIT UPHOLDS SCIENTOLOGY ARBITRATION, DENIES GARCIA APPEAL

[The Garcias and Judge Whittemore]

The same day that the appeal by Danny Masterson’s accusers was heard in Los Angeles regarding Scientology’s ‘religious arbitration,’ the federal Eleventh Circuit handed down its long-awaited ruling in the appeal by Luis and Rocio Garcia regarding the same subject. And for the Garcias, it’s bad news: the federal appeals court has sided with Scientology.

The decision just hit the wire and we’re going to post it right away. Please read it along with us and help us see what the court’s reasoning is.

The timing is startling. The same day religious arbitration’s elements — like the International Justice Chief’s role — was being questioned by the California appellate justices, in Atlanta the federal circuit has decided that what the Garcias went through in Scientology’s jackleg arbitration was not “unconscionable.” Wow.

Please note that there’s a dissenting opinion included with it by a Justice Rosenbaum. We want to hear your thoughts on both.

You can’t make up the rules as you go along. It’s a basic concept of fairness, and it’s one that applies to arbitration as well. No wonder. If a party to the arbitration can create the rules governing the arbitration as the arbitration progresses, it enjoys an insurmountable advantage that effectively guarantees its victory. That’s not an arbitration; it’s just plain arbitrary. And a federal court should not be a rubber stamp for the kind of inherently unfair, anything-the-arbitration-contract-drafting-party-wants-goes “arbitration” that necessarily occurs when the agreement-drafting party can subject the other party to whatever rules it desires — even changing the rules — as the arbitration unfolds. I would vacate the district court’s order compelling arbitration here because the arbitration agreement is not a valid agreement to arbitrate. Rather, in requiring the Garcias to agree to be governed at arbitration by rules that did not exist and would be devised by the Church and evolve while the arbitration proceeded, the arbitration agreement was as one-sided and unconscionable as an arbitration agreement can be.

“Captain Bill said in his tech briefing number five, it’s on Youtube, that once you do ot3 and the solo stuff you will no longer be at affect of the implanters. I disagree because once someone has done that stuff they still have to breathe chemtrail air, they still have no idea what chemtrails are, they still can get tricked by a false flag like 9/11, they still can get abducted by an alien and get semen taken then have a false memory implanted as to what occurred during the abduction. I’m sure they’ve had great wins but I think what Captain Bill has said makes someone think they can become invincible just by doing the levels alone. I don’t think so.”

1995: Jeff Jacobsen provided a summary of the Cult Awareness Network Conference held last week in White Plains, NY. “About 270 attended and about a dozen Scientologists hung around the hotel bugging people. Early Friday morning Snipe and I set up his computer in the book sale room and gave an Internet demonstration during the day. I think we made several converts to the net there. At supper CAN officials told that they have filed Chapter 11 bankruptcy (this is to reorganize, not dissolve) in order to win time to appeal the Jason Scott decision against CAN. There is also a CAN lawsuit against Scientology and Bowles & Moxon I think on conspiracy charges based on the 46 lawsuits that Moxon apparently boilerplated against CAN.”
