We’re continuing our conversation today with Jane Doe 4, the actress Tricia Vessey, who testified as a “past bad acts witness” at the Danny Masterson trial on November 9 and 10

And today, we get into a discussion with her about why Masterson is not facing charges based on her allegations. Looking at her testimony, doesn’t one or both of her incidents satisfy the requirements for “forcible rape” under California law?

We can’t help wondering, if there’s a retrial of Masterson in the spring, should he this time face four counts of forcible rape?

Also, Tricia talks about the moment she brought up Masterson’s DJ name, DJ Donkey Punch, during cross-examination, which we know you want to hear about!

“Recently I contacted some very interesting facsimiles of Captain Frank de Wolfe of the United States Army, who was wounded at Fort Donelson in 1862. You may think I am talking about a past death; I am not. I am talking about a sympathy facsimile picked up when I was about a year and a half old, evidently, on the death of my great-grandfather. I almost killed myself. I started running out a lot of emotional curves and life began to look more and more interesting, and then when I went to get up out of the chair I couldn’t get up. I wondered what this was all about so I began to run some more emotional curves, and then I suddenly recalled that my great-grandfather had a black cane with a solid gold dog’s head. It was a great little gimmick, this solid gold dog’s head. The facsimile which I had just finished running out was the facsimile of the death of my dog when I was 14, which tied in to the cane with the dog’s head, which was the death of my great-grandfather that occurred while I was still sick with pneumonia when about a year and a half old. “Every person he owed money to, including me and except Mary who took hers to Court (hers was different, not an advance payment but a specific loan) we worked out a handle so the person wasn’t harmed. He then received L10 and L12 from me. So how then is he in a condition of Enemy? The treason/enemy conditions were always wrong indications, the condition was danger that never never were fully handled and so repeated.”

1999: “Xenubat” reported a protest in San Diego. “Me, Barb and Conner decided to pay a visit to the San Diego org today to do a picket in memory of Lisa McPherson. I had on my ‘Who Is Xemu?’ picketing T-shirt, and, this being a typical San Diego day with wonderful weather, I didn’t even need to wear my sweater which I had brought with me. I had my ‘Lisa’ picket sign with me: The first side had two pictures of Lisa McPherson and said, ‘YOUNG. PRETTY. DEAD.’. The other side said, ‘DID 100% STANDARD TECH KILL LISA McPHERSON?’ Barb’s sign said, ‘SCIENTOLOGY KILLED LISA–1959-1995’; the other side ‘RON IS GONE BUT THE CON LIVES ON’. Conner’s sign said, ‘SCIENTOLOGY INDICTED IN DEATH OF LISA McPHERSON, DECEMBER 5, 1995’ and ‘$CIENTOLOGY–$ECRETIVE RELIGIOUS $CAM’. I don’t think we had been there two minutes when the driver of a car going down Ash that was waiting at the stoplight honked his approval and yelled out, ‘Thank you so much!’ He actually thanked us twice, said he was glad somebody was out there doing this (picketing) and as the light turned green and he went by, he yelled, ‘L. Ron Hubbard was a psycho lunatic!’ A short while later, a woman driving another car going down Ash yelled out, ‘Why don’t you guys go home and knit?'”

“Miscavige is a crime boss. If you’re a crime boss or a loan shark you can’t let somebody disrespect you or not pay back a loan, you have to make an example out of them to keep the rest of the underlings in line. This is more important than public perception.”

Criminal prosecutions:

Danny Masterson charged for raping three women: Mistrial declared November 30. Status conference scheduled January 10, retrial scheduled March 27.
‘Lafayette Ronald Hubbard’ (a/k/a Justin Craig), aggravated assault, plus drug charges: Grand jury indictments include charges from an assault while in custody. Plea deadline scheduled for December 16.
Jay and Jeff Spina, Medicare fraud: Jay sentenced to 9 years in prison. Jeff scheduled to time served with three years supervised release, restitution of $9.7 million.
Rizza Islam, Medi-Cal fraud: Trial scheduled for March 1 in Los Angeles
David Gentile, GPB Capital, fraud: Next pretrial hearing December 9.
Yanti Mike Greene, Scientology private eye accused of contempt of court: Found guilty of criminal and civil contempt.

Civil litigation:
Baxter, Baxter, and Paris v. Scientology, alleging labor trafficking: Complaint filed April 28 in Tampa federal court, Scientology moving to compel arbitration. Plaintiffs filed amended complaint on August 2. Hearing November 17 to argue the arbitration motions, awaiting ruling.
Valerie Haney v. Scientology: Forced to ‘religious arbitration.’ Selection of arbitrators underway. Next court hearing: February 2, 2023.
Chrissie Bixler et al. v. Scientology and Danny Masterson: Appellate court removes requirement of arbitration on January 19, case remanded back to Superior Court. Stay in place at least through February 7.
Brian Statler Sr v. City of Inglewood: Case settled ahead of scheduled Dec 6 trial.
Author Steve Cannane defamation trial: New trial ordered after appeals court overturned prior ruling.
Chiropractors Steve Peyroux and Brent Detelich, stem cell fraud: Lawsuit filed by the FTC and state of Georgia in August, now in discovery phase.
