The Danny Masterson court cases and Scientology: A video update

YouTuber Derek Lambert asked us for an update on what’s going on with Scientology and the courts, and we were happy to fill him in.

As always, things are a little complex because Scientology celebrity Danny Masterson is being prosecuted in criminal court in Los Angeles (next hearing February 8, trial August 29) at the same time that he and the church are being sued civilly in a separate matter.

We tried our best to have it all make sense to Derek. Please let us know how you thought we did.

“I think it’s great that the church has a healthy second dynamic, like you see young people running their orgs, very likely they are Scientology kids. Maybe it has something to do with marriage being respected and abortion being avoided. We don’t seem to have a young generation in the Free Zone. I guarantee you the church will always exist because it’s got a second dynamic, of course only in a quiet way though but that’s better than nothing. Past is Prologue

1996: John Travolta appeared on the Oprah Winfrey show and discussed Scientology with an uncritical Oprah and audience. “OPRAH: Every time you say the word people get… I know back there my producers are going OOHH my God Scientology. TRAVOLTA: You can be a Catholic Scientologist and a Protestant Scientologist and a Baptist Scientologist. We have every denomination. OPRAH: So what is the center… I never understand, what is it… TRAVOLTA: It’s mainly to help you survive better on the planet. We’re in trouble on this planet, you know, in a lot of ways. OPRAH: So is it… It’s not a religion? TRAVOLTA: Well it is technically, because by law, and by the dictionary, you have to go… that term. Because it deals with the spiritually end… through spiritually and physically at times… Like Dianetics is the body… It deals with injuries, and emotional upsets, and things like that… That’s very specific and it deals with the body, and the mind. — Jay and Jeff Spina, Medicare fraud: Jay sentenced to 9 years in prison. Jeff’s sentencing to be scheduled.
— Hanan and Rizza Islam and other family members, Medi-Cal fraud: Pretrial conference December 17 in Los Angeles
— David Gentile, GPB Capital, fraud: Next pretrial conference set for February 11.
— Joseph ‘Ben’ Barton, Medicare fraud: Pleaded guilty, awaiting sentencing.

Civil litigation:
— Luis and Rocio Garcia v. Scientology: Eleventh Circuit affirmed ruling granting Scientology’s motion for arbitration. Garcias considering next move.
— Valerie Haney v. Scientology: Forced to ‘religious arbitration.’ US Supreme Court denied Valerie’s petition Oct 4.
— Chrissie Bixler et al. v. Scientology and Danny Masterson: California Supreme Court granted review on May 26 and asked the Second Appellate Division to direct Judge Steven Kleifield to show cause why he granted Scientology’s motion for arbitration. Oral arguments held November 2, awaiting a ruling.
— Matt and Kathy Feschbach tax debt: Eleventh Circuit ruled on Sept 9, 2020 that Feshbachs can’t discharge IRS debt in bankruptcy. Dec 17: Feshbachs sign court judgment obliging them to pay entire $3.674 million tax debt, plus interest from Nov 19.
— Brian Statler Sr v. City of Inglewood: Third amended complaint filed, trial set for June 28, 2022.
— Author Steve Cannane defamation trial: Trial concluded, Cannane victorious, awarded court costs. Case appealed on Dec 23. Appeal hearing held Aug 23-27. Awaiting a ruling.
