Today at 9 am in Los Angeles (noon here in New York, 4 pm in London) we’ll be listening in to the livestream at California’s 2nd Appellate District as oral arguments are presented about Scientology’s “religious arbitration.”
What’s at stake is an appeal by Danny Masterson’s rape accusers, who want the court to overturn a lower court ruling that has denied them the right to sue Masterson and the Church of Scientology for what they claim is years of surveillance and harassment.
This is a complex case, and if you listen in, please keep in mind that pretty arcane points of law are going to be argued today, not rape allegations.
In late 2016 three women — Chrissie Carnell-Bixler, Jane Doe 1, and Jane Doe 2 — came forward to the Los Angeles Police Department with allegations that they had been raped by Danny Masterson years earlier when they were members of the Church of Scientology. They say they didn’t come forward sooner because they didn’t know about each other and because they were terrified of retaliation from the church.
After they did come forward, they say they have been subjected to constant surveillance and harassment. (Which, we pointed out Saturday, continues to the present day.) So, while they waited for the LAPD and the District Attorney’s department to charge Masterson criminally, in August 2019 they filed a civil lawsuit against Masterson, Scientology, and Scientology leader David Miscavige. The lawsuit is only about the harassment campaign, and not about the rape allegations.
Joining them in the suit was Chrissie’s husband, rocker Cedric Bixler-Zavala, and a fourth woman, Bobette Riales, who had also joined the LAPD investigation with her own allegations of being raped by Masterson, but she was never a Scientologist.
In June 2020 the District Attorney’s office did charge Masterson for violently raping Chrissie, Jane Doe 1, and Jane Doe 2. His trial is tentatively scheduled for February, and if he’s convicted he’s facing 45 years to life in prison.
In December 2020, the civil lawsuit was derailed when LA Superior Court Judge Steven Kleifield granted a motion by Scientology denying the plaintiffs right to trial. Kleifield had agreed with Scientology’s argument that as former Scientologists, four of the plaintiffs (except for Riales) had signed service contracts obliging them to take any grievance — even allegations of stalking and harassment occurring years after they were in the church — to Scientology’s own brand of “religious arbitration,” which requires an arbitrating panel of three Scientologists in good standing.
The plaintiffs petitioned the California Supreme Court, which granted review of the case in May. That’s resulted in today’s hearing at the 2nd Appellate District, where the two sides will be arguing about Kleifield’s ruling.
Again, they will not be arguing about the rape allegations or whether Danny Masterson has committed a crime. They won’t even be arguing over the civil lawsuit’s allegations of harassment. This hearing is strictly about Kleifield’s ruling which granted Scientology’s motion to force the case out of court and into its “religious arbitration.”
The appeals court asked both sides to submit letters about whether, with its all-Scientologist arbitrating panel, Scientology’s proceeding could be considered “neutral.” So we figure both sides will primarily be addressing that question today.
Here’s the lineup that is scheduled for today.
Constitutional scholar Marci Hamilton is representing the petitioners, and she’ll have 15 minutes.
Matthew Hinks is representing the Religious Technology Center (RTC), and he’ll have 5 minutes. RTC is the nominally controlling entity of the Scientology movement, and Miscavige is its “Chairman of the Board,” hence his nickname in Scientology, “C.O.B.”
Andrew Brettler is representing Masterson, and he’ll have 5 minutes. Brettler’s gained a lot of notoriety since it was revealed that he is now representing Prince Andrew in a lawsuit filed by a woman who says Jeffrey Epstein gave her to the Duke of York as an underage sexual treat.
William Forman is representing the Church of Scientology International and the Celebrity Centre International, and he’ll have 15 minutes.
