The particularly bad timing of Monique Rathbun’s decision to fire her attorneys

We wanted to follow up yesterday’s blockbuster news with some important details. Namely, where Monique Rathbun’s lawsuit against the Church of Scientology is today, and what immediate deadlines it faces.

On Friday, Monique’s attorneys filed a document with the Texas Supreme Court which revealed that they had been fired “without cause.” In the filing there was no notice of new counsel representing Monique. There was no request for a stay of proceedings so that new attorneys could be brought on and learn the case. Assuming the court accepts the withdrawal of her attorneys, Monique is currently without counsel of any kind. One of the consequences of this is that the home address of the Rathbuns was included in the document — if Monique still had representation, we might not even know that the Rathbuns had returned to Ingleside, near Corpus Christi.

In our comments, we saw numerous people suggesting that Monique might simply be switching attorneys. While that’s possible, our experts tell us it’s not likely. Ray Jeffrey and the others, Marc Wiegand, Elliott Cappuccio, and Leslie Hyman, were working on a contingency basis, and had racked up a huge amount of work in the time since the lawsuit was first filed in August 2013. Because they were fired “without cause,” they would still be entitled to their percentage of any future settlement in the case, which we believe would be around 40 to 45 percent.

It makes no sense to fire attorneys on a contingency basis to bring one on who is going to charge by the hour, so that’s probably not going to happen. Is there another attorney who is going to come in and work on a contingency basis? That’s possible, but the enormity of the case would mean that it would take weeks for a new attorney to get up to speed. And Monique doesn’t really have that much time.

On February 19, the defendants in the lawsuit face a deadline of turning in their petition to the Texas Supreme Court. They have already received two extensions, and this last time, they were told that an additional extension would be “disfavored.” It’s very hard to see David Miscavige instructing his attorneys to miss that deadline and a chance to petition the Texas Supreme Court without a settlement worked out. That leaves very little time for a settlement to happen, and our best information tells us that those talks have not even begun.

Speaking of the petition, we’ll remind readers where this lawsuit is currently. Scientology is asking the Texas Supreme Court to review a devastating decision by the Texas Third Court of Appeals which shot down Scientology’s argument that its harassment of the Rathbuns was a form of free speech. Our legal observers tell us there was a good chance that this decision would have been upheld by the state supreme court, and that Scientology had every intention of then taking it to the US Supreme Court — and a loss there would have been huge for anyone who wanted to sue Scientology in the United States for harassment. That won’t happen now.

We will be watching the docket closely to see if a new attorney does make an appearance for Monique, or to see if the case is ended, which would suggest a settlement is reached.

    The great mystery to me is the threat against Tony. I’ve been here on and off for years and not once did Tony treat Marty or his plights with anything but journalistic integrity. Makes me think indeed that any sort of settlement involves them doing some things for the Osa crew. Marty hasn’t always been the most stable person in my opinion but..Tony has a job, writes novels, takes care of his pets and isn’t compensated daily to work hard at getting the truth out there daily about this sinister cult. I’m sure he’s helped more people leave than he’ll ever imagine. I knew one who was in for decades until they started to read this blog. Fuck you marty! Some people love to bite the hand…

      Here’s what I think: some lawyer said “fire them. I’ll represent you and get a big settlement. I promise.” The Rathbuns jumped on it. That lawyer, however, is really a friend of Miscavige and will represent his interests.

      Tony published the court document yesterday that had the Rathbun’s new address back in their old stomping grounds of Ingleside, TX. Their home address was on the document because they had no attorney address to list. I think if Tony would have noticed that, he would have blacked it out, but it was nevertheless posted. It’s possible Marty is blaming Tony that the Co$ has their new address, when he has only himself to blame for not thinking this issue through ahead of time.

    I was not going to start a new thread for 2016 for two reasons. Firstly; the amount of Co$ bad press last year was quite time consuming to keep up with and I had to start abbreviating the list of links the last 3 months of the year. Secondly; it seemed like hardly anyone was checking out my monthly installments of the thread. This made the task daunting and uninspiring, but I felt compelled at least to finish the year because I am not the type of person to quit a project before it is complete.

    I decided to continue my project of collecting Co$ bad press for 2016 because a few people responded saying my threads were a valuable archive of links. 2016 will be my third year. This year my lists will be a bit more abbreviated than the previous two years, and I decided to include Tony Ortega’s articles at the Underground Bunker as well. The only reason I did not include Tony’s articles in the past two years of threads is because anyone who reads or finds Tony Ortega’s articles on Scientology will find that he is a journalist who does his research and has enough guts to expose the truth about Scientology and it’s complex criminal activities on a daily basis. I was hoping that other media outlets would follow suit and begin to do some research on the complex shenanigans of the Church, it’s front groups, it’s leader and members.

    I only learned of this today, so excuse me for being behind the curve. I immediately went to Marty’s blog, looking for info that might help me wrap my head around this shocking development. Marty’s post, “Mark my words. Tony Ortega and his unnamed sources will rue this day when they declared Monique Rathbun as fair game and subjected her to intentional libel,” freaked me out. Marty knows the UB is the forum of choice for supporters of Monique. So WTF!! My hope is that this is a hoax perpetrated by $cn-paid hackers working to drive a wedge between the strongest parties (UB and ex=$ci execs) working to – say it loud and proud – destroy the so-called church.     Many people here and on other boards were rooting for Monique so that she could land a blow on Scientology as revenge for what they did to so many people who have no voice. I cannot believe that Monique made this decision, and if not, then it was Marty. I honestly believe that by this act, Marty has shown that he is too far gone for redemption or to join the fight against Miscavige.

    I pity them both. We all know what comes next.

    IMHO, the speculation of others over these past two days of other Bunkeroos has helped me put into perspective the shocking news. I can’t say I understand what is going on, far from it, but at least I find it comforting about human nature that so many very intelligent peeps have posted here about what they think is going on, and/or what may happen.

    Like the consensus… I wish the best for the Rathbuns.

    After ruminating over this for a while (I had a lot of driving to do in conjunction with work yesterday and this morning), I think that a large part of the disconnect here is due to misunderstanding. For a very long time Marty was in a closed system that viewed all reporters as literal Merchants of Chaos. Once out, he met one of these people (Tony) and discovered that he was not actually as described by LRH. This grew into a friendship, but one that was always predicated on the fact that Tony Ortega is a real, working journalist.

    For Tony, the Story is always paramount– and reporting the facts trumps pretty much anything else. And (and this is key), it is never personal. For Tony, yesterday’s news item, factually presented, was a part of the ongoing story. But to Marty, it amounted to a personal affront– an attack if you will.

    What is particularly ironic in all this is the Scientology view that, in their superior state of Big Beingness everything is done on the basis of cold, sober science, as filtered through the awesome, awesome discoveries of Source. Personal feelings and beliefs are swept away by the surety that comes of having a reliable Tech that never fails, so long as it is properly applied.

    Having said all that, all I can conclude is: “Hey, Marty! It’s not personal! Get over your bad self and let your friends (even the ones who are real journalists) in on what is going on!”

      Very well said. As a never in, I don’t know all the details of Marty’s “beingness” that many others here do. I will say that there are 2 things few (if any) have mentioned, though:

      1) I’m sure this suit puts him (and his family) under a tremendous amount of pressure

      2) I’m sure there is a somewhat significant risk associated with having filed the suit to begin with, even though it is his wife who filed it

      Expect people to do whatever they need to do to protect themselves under these circumstances.

      I certainly understand reporting on the facts and not putting those facts through any filter. But, as a former newspaper reporter, I don’t think I would have made the choice to include the the third lawyer’s analysis that mentions mental illness. While it’s completely true that it is this person’s experience of cases in the past, and I assume this attorney isn’t specifically speaking of the Rathbuns, it does assign a medical condition to people who make these types of decisions. Speculating about someone’s having cancer, AIDS, depression, etc., is a bit unfair. Maybe Tony knows that Monique isn’t suffering or in treatment for a mental health condition. I sincerely hope she isn’t. But I did read Marty’s book where he describes his brother’s commitment to a mental institution, so the subject of mental illness likely hit a nerve. What Tony printed techinically isn’t libelous (I’m guessing Marty’s response is referring to the libel standard of public disclosure of private and embarrassing facts), but I can see how the lawyer’s mention of mental illness could interpreted as anyone making a decision like Monique did must be crazy, so she must be mentally ill. It’s completely Tony’s prerogative to choose to include it. My former colleagues and I routinely debated whether or not to print something. Often you can print it, but should you? Either way, I support Tony’s right to make those calls. Just my 2 cents.

          You’re right. I shouldn’t have used the word “any.” What I meant was that I don’t believe Tony uses a filter that results in a different standard of journalistic integrity. His critics like to say that he only reports on the negative aspects of Scientology and dismisses its good works. Problem is, there aren’t any. I believe he would print positive actions by them. Heck, even dictators like Saddam improved roads and health care. But Scientology doesn’t do anything tangible that benefits its members or society. Thanks for the response πŸ™‚

    Marty’s break from Scientology indoctrination has been interesting to watch. He and Monique forged a very different path for themselves. With Scientology hounds viciously snarling and snapping at their heels, they have not had the luxury of peacefully pursueing their own dreams. Miscaivge wanted it that way.

    It would not surprise me if, with his intimate knowledge of Miscavige and OSA tactics, with or without the guidance of Monique and her legal team, he has brokered a deal with Scientology. Any agreement may have been contingent on Monique (and Marty) foregoing any further legal action in the case against Scientology, hence necessitating releasing her legal team, who would undoubtedly.be handsomely compensated for their involvement.

    Marty has the smarts, savvy, inside skinny and incentive to negotiate a more-than-satisfactory settlement one way or the other. Ask the IAS.

    Anyhow, I wish the Rathbun family the freedom to get on with their lives without Miscavige and his ill-begotten cult.

    Firing your attorney is much worse than changing attorneys. If they had new counsel, then there would be a “Substitution of Counsel” filed. If fired without cause, her attorneys are entitled to all of their time. This reminds me of the McPherson case. When retired judge Beach was assigned to the case after our best judge recused herself because of her finding of SCN suborning perjury to get rid of me or dismiss the case, Judge Beach said the McPherson case was too big to set for trial and why was it not settled. SCN REPLIED THAT IT WOULD NEVER SETTLE IF DANDAR WAS COUNSEL. So Beach illegally made my attorney the lead attorney, without the client’s consent, and made me a figurehead. So this may have been what happened to Monique: “fire your lawyers , then we settle.” Why so questionable? Because her lawyers have done a fabulous job!!!

    Finally going to construct a semi-cogent thought about yesterday/today.
    My interpretation of Marty’s “rue the day” statement is that it is directed to Tony @ The Underground Bunker, not Tony Ortega AND the Underground Bunker commenters.

    Many of the comments I’ve read these past two days, both here and at Rathbun’s blog, have voiced how most all bunkerites are 100% supportive of Monique (rightly so) and it’s not fair for him to think otherwise of us. (This is not to say that TO doesn’t also support her.) However, my read is that Marty, for whatever reason, is singling out our proprietor and not our comment section. (I hope that made sense to everyone. One of my worst faults is that I’m terrible at explaining things.)

    An additional personal perspective is that Tony reported on a court filing….an open document for any and all to find, read and report. No secrets were revealed or confidences broken in such an act. That is where my confusion begins and ends.

    My best guess is we will never know the rational behind the moves and statements of the past two days and I’m ok with that. OF COURSE, I want to know every detail and will welcome any meat that sticks to this bony mayhem, but am prepared for it to forever be a mystery sandwich.

    Apologies if my rambles have already been said more concisely and in a more understandable monologue in previous posts. Just haven’t been able to keep up with all of them.

      Lovely to hear from you, as always. If I didn’t know it was unethical and impossible, I would speculate that the Rathbuns’ attorneys are Tony’s inside sources. Therefore the vitriol from Marty. But if that were the case, the Rathbuns would have fired their attorneys citing unethical practices – and made sure the judge knew it, therefore losing their share of the fees due at settlement. I think I’m overthinking this. My puzzler hurts.

        The live blogging and the after-partying comments from the night of Theroux’s premier praised Mango’s part in ‘My Scientology Movie.’ Ok, I’m cool with that. However, after following his Periscope feed off and on for a couple of months, my respect for him is at a low. Maybe it’s a result of being in the chult (but I doubt it) or it’s a young guy making sketchy decisions. That said, I do not think his periscope antics marginalize his experience in CoS or the veracity of his chult knowledge….he just makes me queasy.

    The beneficial aspects of being a critic of Scientology are all put on hold. I prefer full speed ahead taking on the cult, with some jokes and personal comments cause we are free and can have individuality, but this is not good, not good at all.

              I just remembered we only have swiss. WHew!!! that’s really not my idea of a grilled cheese. Gouda, or Havarti, with a thin layer of cream cheese on the bread, and lots of butter on the outside. Put a few drops of water in the pan and put a lid on it to steam melt the cheese. I like the fact that we have silly arguments and jokes about a very serious and hateful organization. I can assure you I am as interested with your posts as I am the goofballs. I could care less if OSA is watching, but I have never been fair gamed , so my attitude may be a little laissez faire.         And people can pile on to compound the problem.

        There’s a difference between disagreement over claims and disputing ideas and exchanging personal insults.

        I disagree with other critics on certain details on Scientology BUT if we are civil and do it in private it doesn’t spiral out of control.

        What one person is comfortable saying in a disagreement that is public may not be what another is comfortable having said about them in public.

I was referring to the two concepts mentioned in the comments, that the Bunker is “cultlike” (Mickey’s comment), and that there are “programs” in Scientology that try to get us to argue, and keep track of statistics regarding same.

          Point being that taking one single measure, however meaningful or not, is not a good method of judging a group. My intent was to express that reasoned argument, however impassioned, is more meaningful than settling for silence. I also do think that personal insults are appropriate.

          I was not taking an opposing point, I was hopefully adding an additional facet.

          I have created a monster Duck.. I put on my tennis shoes and she knows I’m heading for my bike.. and dances around until I put her into the pouch..

          That pouch is perfect.. she pops her head out when she wants and can cuddle in it for a nap.. She’s my sweet Rescue Dog.. and is I think around 13-14 yrs. .. 5# ( She gets anything she wants! )

    Whatever the reasons for this break with their attorneys etc. Marty has no place complaining about people speculating what’s going on. he should know that people will speculate, ask questions and want to know what they are thinking, particularly as it doesn’t seem to be the best legal strategy. He and Monique are public figures now, for better or worse. and he knows better than anyone the amount of heartache and pain inflicted by the COS and that people are invested in the outcome of any case having to do with the COS. What he should do now is make a statement. or better yet, Monique should. it doesn’t matter if they feel they shouldn’t have to explain themselves to anyone, they lost that right by dint of being public figures – and if they don’t want to make a statement, then there should be no complaint about what commenters or journalists have to say. you can’t have your cake and eat it too.

I guess I was feeling more like in this circle of people in the blogosphere; which I would think would be a safe space for them because of their long association with you. to those of us who read this blog and Marty’s blog, she is well known. and again, I wasn’t saying that she HAS to do anything. but then Marty should not make quasi-threatening posts on his own blog when people talk about your story. Especially since I didn’t read anything that was even close to “fair game” tactics as commentary. Most people were and are very supportive. if he didn’t want you to break the story, he should have said something first, but if they can’t talk about it for legal reasons or whatever, then don’t say anything at all.

    I need to vent about that site. Yes Tony Ortega is a β€œjournalist”, but that does not give him the right to report news on a private matter without Marty or this wife’s consent especially for something as sensitive as a lawsuit against a criminal organization. He could have waited for Marty to clarify. There is an increasing problem at the Bunker its becoming a bit cultish over there. I used to read Tony’s stuff since the village voice, and noticed that change. If you comment something against there views you will be harassed and called a troll or OSA not to mention some of them are coming from celebrity gossip websites, so they really don’t value privacy of who they consider β€œpublic figures”. They constantly posting irrelevant gossip items, and cheesy embarrassing Photoshopped pictures that looks like forwards for grandma, and not one of them is as funny as they think they are. Not all of them are bad. Their are ex- Scientologists that I learned for a lot from them and admire, but Tony’s cite needs a lot of cleaning up. Finally watch them prove me right by calling me a Scientologist. They don’t take criticism well

        PS..Frederick Johnson was never brought up again in our house.. we didn’t get all the free pictures we wanted .. and that was the one and only time I ever saw my mom and dad acting like POD people.

          Rollercoastering. I had a really hard setback when I found out this week , we won’t be able to have a memorial until spring or summer.
          I’m normally a pretty intuitive person, and every time someone has passed in my life, there has been a sense of peace I could connect to. I don’t feel it, in fact I don’t feel my sister at all, and I’ve seriously tried. I don’t know if that’s denial or what.
          But thank you for asking Baby. It does help to talk πŸ™‚

    One intriguing SPECULATION that keeps cropping up is that Miscavige has shuddered the Rathbuns into silence by threatening to reveal Marty’s dirt. However, it makes no sense to me for the following reasons:

    1. Nobody outside of scientology puts much creedence in what Miscavige says. Now granted, this is assuming that Miscavige thinks rationally (or at least his lawyers manage to convince him to). But it would appear to me that if he starts dishing–even if he tells the truth–this would be seen as nothing but a despair move, similar to the hate videos they’ve been posting for years–to little effect outside of the “church.”

    2. If Marty were under such threat, why would he fold and dismiss his lawyers? He would need them more than ever to make sure that proper gags are negotiated and applied to Miscavige and his minions.

    3. Whatever dirt the “church” may have is most likely of no legal consequence due to the statute of limitations. Granted, they could make Marty look bad. But does he really care about yet another volley of that?

    4. The “church” could have done so a lot sooner. Why wait so long?

    5. Undoubtedly, there is dirt on Marty. However, all of this dirt also implicates the “church” as he was doing their bidding. If they were to come out now and confirm that Marty destroyed evidence in the McPherson trial or did something really nasty to the IRS, it would have a much more adverse effect on the “church” than on Marty.

    For example, it may shame the IRS into revisiting their settlement, or kick up the McPherson dirt again in a very public way. It would also make some of the whales and celebrities very nervous. It’s bad enough that they are associated with such a toxic brand to begin with.

    It’s very likely that the worst case scenario for Marty would be that he’d have to turn state’s evidence in the pursuit of the real criminals.

    I don’t see the mutually assured destruction scenario, but I’m open to suggestions…

After the stellar Slamming of Co$ in 2015, unsettling news like this in early 2016 is a letdown, for sure. But the boulders are rolling downward, make no mistake.     Everyone has their price, they say. Marti and Monique must have paid a fair amount in legal fees already. An offer is probably too good to refuse especially if it includes settling the Rathbun’s legal fees in full.

        As Tony has indicated, this notion of “wasted years” is false. Having the attorneys work for you on a contingency basis means that you don’t do jack shit until there’s an actual court hearing in which you need to show up to testify. Back when the case was in front of Judge Waldrip Mosey only showed up to about half of those hearings. Marty himself wasn’t even at one of them. He did not go to the Appeals hearing, and neither did Mosey. How did that waste their time? All they needed to do was live their life and let Jeffrey and Co. do the work, then wait for either a large settlement offer or a victory.

          It is not a waste of time, as you point out, the time is insignificant amounts.

          It is the wasted life moments > and I’ll explain. If you have ever been indicted for trial for say, cannabis possession with no intent to sell, in a state and at a time when such a charge, a felony, would mean 2 to 5 yrs jail time.

          All those months, with really no activity. From the 1st hearing, the preliminary, through to the sentencing or resolution hearing, may take 1 year 3 months.

          I attest that all moments of those 15 months are overwhelmingly affecting each second x second of the individual’s life. There is no time out. There is *always* the awareness of the circumstance and the possible consequences.

          Those 15 months become a tough time to endure.

          This is the time that Monique and Marty don’t want to waste, with a massive legal event with a malevolent opponent in their consciousness, for all that time.

          They want out. And they are, obviously, finding a way to stop it all.

            I just think you are comparing apples with oranges here. Waiting around for a case to resolve while being the indicted focus of the case is much different than being a plaintiff in a civil suit. Of course it is stressful to deal with a possible conviction which may include a hefty fine and or jail time. Mosey is not going to have to suffer any such thing at the end of this. She doesn’t even have to worry about paying the legal team.
            But, whatever they want to do….fine. I’m beyond giving a damn anymore. Serves them right if DM kicks up the surveillance and harassment again. And he probably will.
            Oh….and I don’t care if they get a big settlement. I have never cared about that at all. If they do, they can shove it up their asses. That is blood money as far as I’m concerned. This was supposed to be about winning with the money as icing on the cake. Not the cake itself.

    My best guess is this was a Bob Minton situation. Something came up that scared Marty and Monique to their core. It is really the only logical explanation at this point. But I would not be surprised to hear from Marty that Miscavige is a great guy and how he was tricked by SP’S. If you think of all his year’s as an enforcer for the cult he probably crossed alot of lines and Miscavige got something solid that did not lead back to him, presented it to Marty and said checkmate.     It’s just the tone of his last blog entry sounds so bizarre – almost as if OSA put it up. Even the choice of language is odd – and not typical of someone distancing themselves from the “faith” as Marty seems to have been doing recently.
