Augustine: How L. Ron Hubbard devised Scientology’s most diabolical legal mechanisms

As a dishonest, misleading, and predatory organization, the Church of Scientology operates successfully only because it has manipulated Western legal systems and contract law in order to gain unfair advantages for itself.

These unfair advantages serve to harm Scientologists through legal, financial, and spiritual means. In this article, we explore the efforts of L. Ron Hubbard and the church to acquire and maintain these unfair advantages. To do so, we examine the crucial 1966-1967 period in Scientology.

As we saw earlier, all of the legally separate corporate churches in the Scientology franchise system use a series of binding contracts. These contracts are designed to strip Scientologists of their legal rights. At the heart of these contracts are legal waivers. These waivers separate Scientologists from their legal rights and protections in favor of the Church.

We are seeing the practical effect of these waivers at work in the Garcia case. The Church is using contracts the Garcias signed to fend off a fraud lawsuit and force the Garcias into binding arbitration conducted by the church itself.

Contrary to what some may think, Scientology’s use of legal waivers is not a post-Hubbard legal strategy. The use of waivers is directly traceable to L. Ron Hubbard and to the period of 1966 and 1967, crucial years when Hubbard created key elements of the Church of Scientology that still exist today. As we shall see, Scientology’s malicious contracts are just the tip of a much bigger Scientology iceberg.

In 1966 and 1967 Hubbard created a secret intelligence-gathering and psycho-terrorism unit within the church. This secret part of Scientology became a “cult within a cult” answerable only to Hubbard. In its first embodiment, this secret unit was called the Guardian’s Office.

In its second and current embodiment, this secret unit is called the Office of Special Affairs. Staffed by Sea Org members, OSA’s publicly stated functions are the handling of the Church’s PR, intelligence, and legal affairs. Conversely, OSA’s covert functions are intelligence gathering and the administration of Scientology’s brand of psycho-terrorism called Fair Game. It is crucial to understand the hydra-headed nature of OSA:

— OSA contains a legal section that creates and keeps files of the malicious contracts signed by Scientologists.
— OSA manages the defense of all lawsuits against the Church.
— OSA plans and conducts the PR affairs of the Church.
— OSA secretly culls “confidential parishioner folders” for information when it needs to attack former Scientologists who speak out against the Church.
— OSA is behind the attacks and hate websites and videos on critics, former Scientologists, journalists, and documentarians such as Alex Gibney.
— OSA was behind the Squirrel Busters operation and the other attacks on Independent Scientologists.
— OSA seeks to infiltrate all “enemy groups” by various means.

The origins of the Guardian’s Office, the Sea Org, and the overt and covert affairs of OSA are, arguably, all traceable to a little known Hubbard policy letter of February 18, 1966. Entitled “ATTACKS ON SCIENTOLOGY (Continued),” section three of this policy letter enumerates what Hubbard saw as successful actions in stopping attacks on Scientology organizations:

“The third group of actions have been positive in stopping attacks:
G.3.1. 1. Investigating noisily the attackers;
G.3.2. Not being guilty of anything;
G.3.3. Having our corporate status in excellent condition;
G.3.4. Having our tax returns and books accurate and punctual;
G.3.5. Getting waivers from all people we sign up;
G.3.6. Refunding money to dissatisfied people;
G.3.7. Having our own professionals firmly on staff (but not halfway on staff);
G.3.8. Going on advertising total freedom;
G.3.9. Surviving and remaining solvent by stepping up our own usual activities;
G.3.10. My catching the dropped balls goofed by others and hired professionals;
G.3.11. Being religious in nature and corporate status.

In order to accomplish the ambitious goals outlined in his policy letter, Hubbard took the following steps in 1966 and 1967:
— Created the Guardian’s Office (GO) on March 1, 1966 in order to have Scientology’s “own professionals” firmly on staff, this where “own professionals” referred to intelligence program operators, operatives, and assorted other GO spies, and agents provocateurs.
— Established the Sea Org on August 12, 1967 and appointed himself Commodore.
— Re-emphasized the use of legal waivers against all Scientologists
— Wrote his infamous policy letter of October 18, 1967 entitled “Penalties for Lower Conditions.” This policy letter called for Fair Game against Suppressive Persons:

— Formally authorized the use of confidential PC folder data against former Scientologists who spoke out or were critical.

The last point is significant, for in 1966 Hubbard formally authorized the GO to provide Scientology’s hired private investigators with preclear folder data; this in order to malign, attack, and smear former Scientologists. Hubbard’s authorization to use of confidential parishioner folder data against former Scientologists comes from a policy letter dated February 17, 1966 entitled “PUBLIC INVESTIGATION SECTION.” In this document Hubbard wrote:

The Public Investigation Section is formed in Division 1, Dept 3, as Section 5.

The purpose of this section is:

“TO HELP LRH INVESTIGATE PUBLIC MATTERS AND INDIVIDUALS WHICH SEEM TO IMPEDE HUMAN LIBERTY S0 THAT SUCH MATTERS MAY BE EXPOSED AND TO FURNISH INTELLIGENCE REQUIRED IN GUIDING THE PROGRESS OF SCIENTOLOGY.”

It is composed wholly of professional investigators. Agencies may not be used…

The section may never be used on Ethics Section matters but may work with Ethics when an ex-Scientologist is involved…

The statistic of the section is dual consisting or the number of cases successfully investigated on specific projects and the number of derogatory news stories appearing that week related to enemies of Scientology related to a specific project…

It will be seen that the section has all the useful functions of an intelligence and propaganda agency. It finds the data and sees that it gets action…

The mechanism employed is very straightforward. We never use the data to threaten to expose. We simply collect it and expose…

The creation of the “Public Investigation Section” reveals Hubbard’s well-formed and documented intent to use both confidential parishioner information and tax exempt dollars to finance and engage in vicious Fair Game attacks against former Scientologists who spoke out. This policy letter also calls for investigations against non-Scientologist persons and groups who speak out. This Hubbard policy continues to this day. As such, it constitutes wanton abuse of the Church’s 501(c)(3) tax exempt status.

Of course, the only way Hubbard’s extravagantly deviant and self-serving machinations could ever possibly work is if the Church of Scientology maintained its IRS tax exemption. I say this because a secular business would be sued out of existence and its leaders arrested on criminal charges for such atrocious conduct. This is why Hubbard emphasized the need for keeping Scientology’s legal and corporate affairs in order in his policy letter of February 15, 1966:

G.3. 11. Being religious in nature and corporate status.

Tax exemption was, and remains, the linchpin of the entire Scientology scheme. Tax exemption is the ultimate unfair advantage Scientology needs and must have in order to survive and perpetuate its dishonesty, greed, and human rights abuses. The church makes money by behaving in such ways.

Scientology’s massive, bloated, and very expensive intelligence-gathering, psycho-terrorism, legal, and PR apparatus exists, in part, to protect and firewall the Church’s religious tax exemption.

In turn, religious tax exempt status allows the Church to get away with outrageous behavior. And even if Scientology spends, say, more than one hundred million dollars per year funding this apparatus, it is just a cost of doing business for the tax-free multibillion-dollar Scientology entity.

The two Hubbard policy letters we briefly examined in this article offer a behind the scenes look at the self-serving legal architecture of the Church of Scientology that the public, and most Scientologists, don’t know about.

When signing contracts, Scientologists see just the tip of the Scientology legal iceberg that could one day sink them in court. They see the tip when Sea Org members ask them to “sign some paperwork.” What the people signing don’t really read, or are not allowed to fully read and consult an attorney about, are the waivers in which they surrender their legal rights. This all goes back to L. Ron Hubbard:

There is no informed consent in Scientology. Rather, the journey into the Scientology Underworld begins by watching a short film called “Orientation” and then signing a contract in which one agrees that Scientology is a religion. And then other contracts must be constantly signed for every course. There is no end of contracts in the Church. I can think of only one other malign spiritual entity who always wants a signed contract from mortals and he has horns and a tail.

            What do you mean by promos, Todd? I saw one of their commercials with no-names. For a longer piece, I would think that if an actor who wanted a Hollywood career was the star of a new Introduction video, he’d be shunned by most in Hollywood. Larry was a $cientologist when he did it.

              They had a copy of the scripts at ESMB ( I think). I’m talking about the promos with the fast, horrible music where they talk about their wins. It’ll say something like, “Act like you’ve just won a million dollars.” Then they have them read that particular script. So many people have blown like you Skip, that they kept having to redo them. Someone mentioned(Torry-?) that they found another script for instructions for a crowd scene at an event. Now that’s out tax dollars well spent, eh?

              Thanks for the info. I figure they can always get $cio dweebs to say a line or two here and there, but I doubt that any well-known celeb who’s a $cio will ever do a commercial for them, nor will any actor worth a damn ever do a longer film for them like Larry did – the stigma is just too big now in Hollywood and elsewhere and isn’t going away. Let’s see if I’m right.

    Terrific venue and packed. Must’ve been close to 100 in attendance, and it was S R O. The stories were grand; people were enraptured. A smashing success.

    (PS: an emergency message text from Spaceman niece left me bolting outta there to help. A fall- a trip to the ER. Thank goodness, no broken bones.)

    Thank You to the gentleman named Paul i was sitting next to he shared his nachos with me and another young lady who sat on the other side of him.. he told me how back in the 90’s he had a friend of his who was in college in tampa in the 90s who ran afoul of scientology and they tried to do to her what they did to Paulette on a smaller scale. he was amazed at how long they have been trying to ruin the lives of people who dare write about them or choose not to join their cult.

    Well, THAT was incredibly fun. Tony and Paulette make a great team, sharing great stories and tidbits and touching moments, plus some scary ones. They are both so charming that you can’t help but love them. The crowd at tonight’s event was far greater than the number of Scientologists at the New York org, with 100 plus a few from my best count. Just from those I spoke to, six different states were represented-people who came just for this electric evening.

    There were quite a few well known Bunker names in attendance, and many of Paulette’s friends, too! I wish I had had a chance to say hi to Paulette’s husband, and to send best wishes to Kate Bornstein–she is so lovely, and of course received a huge cheer from the crowd.

    There are probably a bunch of posts already here down the commenting stream, so you already know about the event.

    It’s hard to describe how special this is-an event that brought so many people together once again, after the California tours, and with many more ahead this summer. If you have a chance to go, take it. And if you haven’t yet opened up the first page of Miss Lovely, well, it’s easy to do. I promise you will never forget the stories here.
    There were some exes in the room, and many more survivors in the room. But Paulette, well, she is such a gracious and warm person, you’d never guess the hell she had been through.

              Jazz has a weird relationship with America. It barely sells, and ironically, it went backwards chasing all the popular rock stuff in the 70s. Remember all those crappy albums where jazz musicians would be forced to do covers of Beatles or Bacharach-David tunes? Jazz snobs reacted by demanding a revival of stuff that was popular in the 40s and 50s. Sad. Loads of jazz stars had to go to Europe to survive and get the adulation they were looking for.

      Someone put a lot more effort into it than usual, tho. Most of the clear certs lately have been congratulatory notes written in bubble letters with a highlighter. If you’re grading on scale, this is an easy C-. And the report card is written in Crayola, of course.

    Now that, the internet is open to the world is easier to see LRH was not the only one funny baloney fast talker, is just that he worked hardest at it to gain popularity above them all, I been listening to the Seth Material from Jane Roberts (May 8, 1929 – September 5, 1984) was an American author, and poet…. see another writer who claims to have written books while she was exteriorized. We have; “Ramtha” Judy Zebra Knight, born Judith Darlene Hampton born March 16, 1946 also an author , Esther Hicks (even thou I respect her because she focuses on love) sorry it fits the bill, and MANY! MANY! more, all of them talk about the origins of life on Earth, past lives, higher knowledge, God, the dynamics of life, how to be free, etc etc etc, very similar to all the scientology crap, any one of them could have created their own cult, even thou they had/have a lot of followers without necesarely becoming a cult, is easy to see how Elroony came up with a religion he is not the ONLY ONE, oh I love the internet!!!!! I feel like I’m out of the dark ages now it feels good to find out.

    OK..just checked into the Bunker….late…and saw the information about the meeting scheduled by Scientology regarding information for drug abusers. THIS infuriates me !! There is not one person involved with this who has any formal education or expertise regarding substance abuse. I just want to slap someone upside the head. Their dabbling in this for profit and manipulation is going to cost more lives down the road. True drug rehab is not a joke…I have had patients try to suicide, patients who have hidden drugs in body cavities then overdosed on them, and patients who despite our best efforts provided by physicians, psychologists, registered nurses and licensed psych techs, still can’t hold it together and run away from the facility to “use” and subsequently die. We know what we are doing, and it’s still a tough gig. These people are idiots and frauds.

      Also in my opinion from experience and having received them all, the methods used not only on the Narconon program and the purification Rundown but there is also their Drug rundown counseling early on the ‘bridge’ and then another rundown later called OT4 which addresses drugs. The real life situations which would predispose one to drug addiction are not addressed. For instance there is no acknowledgement that depression or PTSD even exist in their minds. Or perhaps poor health. They unfortunately have been brainwashed and have forgotten how to think for ones self. Could even say THEY were addicted rather severely I would say.

        That is a really good point about them being addicted. Yes, you are right in that most patients who have drug or alcohol issue are “dual diagnosis” patients. That means they have concomitant issues with depression, Bipolar disorder, PTSD, Hx of child abuse, and other factors, and if those issues are not treated by appropriately licensed and specialized personnel their addiction doesn’t stand a chance of being cured. Plus, these people actually attempting real rehab is so frightening to me because they have no idea what they are doing, nor do they have the training to recognize serious medical issues that will most certainly arise, much less know what to do about them.

          Kay, you are correct to be alarmed. Persons are dying in their (Narconon) care. Person’s are dying under the care of Scientology. Many many of my friends and my friends friends have died from what I have called heartbreak because it took me a few years of leaving scientology to believe in depression. Because of the indoctrination persons who ‘believe’ in ‘the tech’ will absolutely not admit to an underlying problem and clean it up. I’ve spent several years now to cleanup my past 35 years ‘believing’. Example I’ve had to remember losing my first child to suicide way back in 1986 and grieve 28 years later because I did not allow myself to when it happened. We tough staff members took pride in that we endured though all sorts of shit while putting the church before all else no matter what it takes.
          Kay, it would be helpful if an instruction book of procedures could be given to layman so we didn’t all have to be trained like you are because a lot of us leaving can’t afford to go see persons like you.

            Cece, I am so sorry for your loss of your child. You indicate you are having to go through the emotions of the loss 28 years later because as staff you did not allow yourself to feel your feellings. I have talked to one person who I have found out that lost several children and believes dianetics/scientology helped her through it. I also am aware that sea org members and staff sometimes are not getting the training up the bridge that even the pubic gets because they are busy, always thought this weird. You don’t have to answer if you don’t want but I am wondering if you got help in scientology at all, if you made it up the bridge to OT 7 and if you felt like any of it helped you at all. This might be a stupid question since you are indicating you are having to process the feelings now, but that indicates to me you did not deal with them in any way then. Was this because you were over worked as staff and were not suppose to have your own upsets while being a staff member? Did you do any scientology work that should have helped?

      Plus the fact that they are doing this at the Rayburn congressional building is very disturbing to me. The fact is that unless you know that these are Scientologists, doing essentially a bait and switch operation to get people into Narconon, etc. it looks like a worthy endeavor. This is truly malevolent. I think I may try to get together with my fellow psych professionals and see if we can do something to stop this, or at least to let the people involved know that this is a scam and a con job.

          I will !!! I am really mad about this. I have some friends who are in Wash DC in national positions who I am going to ask for help with this advocacy against mental health fraud perpetrated by the church of scientology. Nothing would make me happier than to get this cancelled. I will keep you posted.

      I do understand that there are complaints about Narconan: that their programs are poorly supervised, that a doctor needs to be on staff, that they need trained certified counselors, that the purify., as done by scientology with people having compromised livers, can actually kill people, that they are simply a front group to get people into scientology. The last is somewhat proved out by a video on YouTube of a mother who was recruited by her son who had been through Narconan, she was manipulated, slapped, into giving a million dollars to scientology.

      However, since alcoholics and addicts often have low self esteem under lying their addiction, I have wondered, in a traditional treatment program, if some of the classes that seemed to help many people, the early communication and study classes, might actually be a good thing to add to an overall program for rehab. You can say it might give patients more confidence, more cause over life, or bring them more up tone. The TRs likewise, from what I have watched in videos, not having done the TRs myself.

      It does seem strange to me that if scientology was not so money grubbing and used more common sense, they probably could have good programs by melding some scientology with traditional programs and much better medical evaluations, if they really wanted to help people.

      After May’s beautiful stats, the let down is painful. Obviously CL now treats our complaints as spams and ignore them, or something more sinister has happened for Boston, LA and Tampa blatant spams not to be removed.
      Where can we complain about CL not keeping to their own rules ?

        I’m sorry to say, I have no ideas. A big flagging campaign is all I can suggest. When I’ve written to CL, I’ve told them how scientology Boston/Quincy is thumbing their nose at CL’s rules, and that it’s luring unsuspecting customers into a scam by offering free services. I told CL to Google the scam. Maybe there’s just no follow up to complaints, with CL carrying millions of listings.

        The only thing I suggested the other night is emailing the FTC regulations and the $16,000 (?) fine to the Boston org directly, to put them on notice that there can be repercussions to what they’re doing, and it may be expensive for them. I’m not going to get into an email war with them, though. I don’t trust them.

        I think a class action lawsuit should be made for fraud and the holdings sold, on winning it, and the proceeds distributed to all those that slaved for false ideals and all those that spent money trying to obtain what they know does not exist, or donated, proportionally to the life time working and money spent.

    This is an extraordinary couple of statements. An organization cleverly devised to harm its own members! So the question is, who is Scientology devised to help? The answer’s obvious: LRH. Yet it appears that LRH was building a long-lasting entity, not just a quickie money pump/torture box for his own temporary amusement. Yet, strangely, he seems to have invested little attention to appointing a successor (or a pathway to succession).

    If it was solely to enrich and empower LRH, then why build it so sturdy?

    And if it was about enriching and empowering the guy atop the pyramid, then why didn’t LRH invest effort into controlling the path to the top of the pyramid?

    Either LRH expected not to ever die (I suppose it’s possible), or he was was completely nihilistic (i.e. happy to seed unhappiness into perpetuity, regardless of how it went down) or the money was never the main goal (i.e. so long as LRH would be ensured of future glorification by COS members, he didn’t care who got crushed and who got rich).

    #3 sounds most persuasive, but then why did he put such fiendish work into the dry, drab, background structures behind the money pump? If money wasn’t his focus, why did he invest such crazy time and effort?

    I guess he figured that unless COS threw off enough money to entice at least one hyper-ambitious psycopath per generation (doesn’t matter who) to lead the thing, the church – and his glorification – would be jeopardized. It’s an instrument designed to offer incentive for some money-grubbing psycho to subjugate humans for LRH’s glorification as far into the future as possible.
