Attorney Scott Pilutik wrestles with the news of the day, from a lawyerly perspective… While the Second Circuit prepares to hear the question of whether New York can subpoena Trump’s tax returns (against Trump’s defense that he’s immune as President), the DC Circuit has just weighed in on whether Congress can subpoena Trump’s tax returns (tl;dr: they can). Whereas the target is same — the tax returns — the legal questions and approach differ due to who is requesting them. The result will probably be the same, however.

Media reporter Yashar Ali was frenetically playing whack-a-mole on Twitter this afternoon, trying to get some journalists to stop spreading the idea that Shepard Smith’s sudden and stunning exit from Fox News had anything to do with a meeting the day before between US Attorney General William Barr and Fox News mogul Rupert Murdoch. Attorney Scott Pilutik wrestles with the news of the day, from a lawyerly perspective… 134 page (which I’ve only skimmed) 2-1 appellate opinion in the other case concerning Trump’s tax returns (last week’s was in a NY fed court, this one is in DC fed court). Upshot is that Congress is well within its constitutional rights a right to subpoena the President’s financial records. One judge – a Trump appointee – dissented.
