The crux of the White House’s impeachment push-back (as expressed in yesterday’s Pat Cipollone letter) is that the House’s inquiry is illegitimate because it didn’t vote to conduct an impeachment inquiry, which robs Trump’s of his due process rights. There have been votes in the past prior to “official” impeachment inquiries in the House.

White House rejects impeachment inquiry with precious 8-page letter, hilarity ensues

The White House today dropped an eight-page letter from White House counsel Pat Cipollone, announcing the White House’s refusal to cooperate with the House’s impeachment inquiry because of a series of not-at-all relevant reasons. Most lawyers will recognize the letter as the type of letter you’re embarrassed to write because it’s all horseshit but the client insists is essential. Typically those letters don’t run eight pages, and typically there aren’t dire constitutional ramifications in play, but that’s where we are.

Defeat of Trump lawsuit has stunning implications for presidential immunity

Yesterday I discussed the first part of the SDNY opinion by Judge Marrero, where he dismissed Trump’s lawsuit seeking to bar the NY Attorney General from subpoenaing his tax returns. The court’s ruling was based on the doctrine of abstention — i.e., the federal court will decline jurisdiction if the underlying matter is already in state court and state court is the right place for that matter to be.
