I have the forms for the direct transfer, and a procedure for doing a direct transfer trustee to trustee has existed since the 401(k) plan started, or maybe within a few months of the start. The most recent revision on the transfer forms is 2013. I just have to get the forms notarized and send them to the plan. The argument that they make for leaving the money in the 401(k) is a valid one, which is that the stock and bond funds charge management fees that are competitive with Vanguard and many other no-load funds. What they underestimate is that people want their money, and want control of it.

In reply to Leigh Andrews. Leigh, you should be able to transfer your 401(k) investment to an IRA with no tax obligation if moved directly (not as a lump sum withdrawal). Fidelity, Vanguard, Schwab etc can all help you with this. If the company 401(k) won't allow a direct transfer than they are up to no good. 401(k) plans have a number of Federal laws they have to follow.

I’m not sure anyone has brought this up, but if the slush fund itself is not a religious organization AND it is run by Sea Org members AND they are not getting paid minimum wage, isn’t there a legal breach there?

Here are some more relevant parts of the 1993 IRS Agreement:

VIII (C) (2):

“An entity is a Scientology-related entity if it delivers religious services to parishioners in a manner prescribed by the works of L. Ron Hubbard and as authorized (directly or indirectly) by Religious Technology Center, Church of Scientology International or other entity…”
OK, notice that RTC, CSI and other entities are essentially interchangeable. Why? Because they are all smoke and mirrors. David Miscavige runs everything.

VIII (C) (4)

” Citizens Commission on Human Rights, National Commission on Law Enforcement and Social Justice, Scientology Defense Fund Trust, Association for the Better Living and Education, Applied Scholastics Incorporated, Narconon International, The Way to Happiness Foundation, and the Foundation for Religious Freedom are Scientology-related entities.”
Note the inclusion of Narconon as a Scientology-related entity. Narconon now has 40-plus lawsuits on its hands.
