I’m not sure what your point is between taking DM’s depo and his being questioned by the court. In American jurispurdence it is extremely rare for a judge to question a witness. I have never seen it done in state court. It does occur in federal court, but never more than a single line of questioning.

My point is that a court case where this information was brought to bear would have gone past the point where the simple answer is to take a deposition from Captain David “he is NOT insane!” Miscavige.
