What I find specially interesting is the fact that Miscavige is using the defense that he is NOT the managerial leader of the C of S, and yet the decision of the Court of Appeals would seem to invalidate his claim by affirming that he is protected by apex. In other words, if he is not the leader in the manner of a CEO, then apex should not apply; yet, the court says it does apply and therefore, it would seem to me that this confirms his role as administrative and managerial head of the church. I think this decision will ultimately boomerang on Miscavige and the church in unexpected ways at some point in the future. Also, I agree that the ruling is stupid and unsophisticated for such a complex issue.

I accidentally deleted my answer but I will try to give it here again in a short form. The Tech is not some weird thing. It’s just procedures. Like how do you go about Starting and Driving a car. There is right ways and wrong ways.

There is a tech for example for the subject of study which agreeably is a subject which is a problem sometimes.

There is a course known as Basic Study Manual (the first version of it didn’t have pictures, though since the early 90’s the church published it in a more “digestible” form with pictures). It has to do with how you study so you can understand, really understand. Not pass exams. I would like to see this “tech” applied to all schools and children of the world. It’s a good thing for children to know the barriers to study.

I am giving you here the definition of Technology from the technical dictionary of scientology (there is also an administrative dictionary but this is for technical words)

HCOB comes from Hubbard Communications Office Bulletin and it’s type of technical policy letter let’s say.

So, there you have it. A piece of tech. tech is not something weird. It’s processes and applications based on some theory. If the theory holds true then through some Tech you could be able to do things with it.

the problem is that a lot of people think all this is crazy and robotism whereas those processes are nothing else but a way, let’s say in the case of study tech, of how to start a kid to be winning in his studies and making understandings.

there are other techs that have to do with processes for the human soul, the thetan as we call it. I am sorry to see so many words being written even by scientologists which are not understood by scientologists, thus creating no understanding right there. That’s one big problem on the internet. Anything goes and you are now supposed to know it and understand it all. But it’s not like that. The moment you have a word you don’t understand you can quit the subject or comment let’s say. You just drop it. Unless you want to get some general idea about it. But if you really want to fully understand it you must apply this study tech and clear quite some words. This is a Huge subject and is the reason why you have so many school drop outs or rebels or bad students or even glib students, students that is who don’t really understand and can apply the data but just “know” the data. They can talk the talk but cannot walk the walk.

We all knew this court case was going to take YEARS to get through from the beginning. More than enough time to be able to show Davey Boy’s true colors. His personal gain from the wealth that comes in as “donations”, the fact that NOTHING gets done in Scn without his personal ok on it first ect. DM’s personal vendetta against his former Inspector General is gonna sink him this time. And we will all be sitting ringside with front row seats and loads of popcorn to see it play out.

Oh and just MAYBE, after all is said and done with the Rathbun case, the IRS and the FBI will finally shut down Scn. Maybe.
