Tell me if this would apply to an organization like Scientology.

Unclean Hands n. a legal doctrine which is a defense to a complaint, which states that a party who is asking for a judgment cannot have the help of the court if he/she has done anything unethical in relation to the subject of the lawsuit. Thus, if a defendant can show the plaintiff had “unclean hands,” his case will be dismissed.

The reason the district court was reversed in the federal case was that the US Supreme Court recently held that, if a state action is pending, federal courts should only abstain from hearing the case if it involves “state criminal proceedings, civil enforcement proceedings, and civil proceedings involving certain orders that are uniquely in furtherance of the state courts’ ability to perform their judicial functions.” I do not believe that any of these exist here. The judgment here was not criminal; there is no enforcement proceeding yet, because Dandar is appealing; and it does not involve state court functions (which, for example, a disciplinary hearing would). The court simply said that Dandar violated a contract with Scientology. I believe that the district court will now hear the Section 1983 case. I also find it interesting that, after deliberating for over a year, the state court decision was so short and did not address the issues.

btw, Scientology won’t see a dime from Dandar. Dandar has a federal case pending against Scientology and David Miscavige will receive a deposition subpoena. Miscavige will resist testifying. He cannot argue that he has never been to Florida (the way he can say, in Mosey’s case, he has never been to Texas). He will do anything to get out of testifying in the federal case and that will mean dropping the state claim, among other things.
