Garcia’s lawyers are smart guys. There is undoubtedly a reason why they didn’t name him personally in the suit. Yet they very deliberately emphasized that he’s the first deposition that they’ll notice. That may be just bluster, or they may really have something compelling (and they may be avoiding revealing what their legal basis is for trying to put him on the stand as a lever to pull to get this case to settle quickly; “if you settle now, then I won’t tell anybody how I was gonna get you on the stand”). I am not sure what lever they’ll try to pull but if it is more than bluffing, it may come out if Tony is able to convince Garcia’s lawyers to publish any correspondence here.

Maybe the Garcias should add Davey as a defendant, just as Dandar did (and notice that nothing has happened to Dandar since he did that).

I vaguely recall that Miscavige has been deposed in litigation, but it was a long time ago. Others who were involved with the cult back in the day may be able to track down the exact case and find dox on the Web. My suspicion is that he was shredded completely despite thinking he could lie effectively to opposing counsel.

It is not accurate to say that motions to quash subpoenas for depositions are “usually denied.” Depositions are typically only supposed to be taken from people with direct knowledge and responsibility for the issues at hand. Thus, you can’t depose the CEO of Exxon about “price fixing” just because you got overcharged a few dollars at one of their gas stations. Otherwise, every lawsuit would automatically try to depose the CEO, as a way of pressuring companies to settle.

It seems likely that Miscavige’s expensive “wog lawyers,” who may be in a state of turmoil after Monique Yingling’s husband is apparently seriously ill, so she’s in semi-retirement to care for him, would oppose any motion to compel his testimony quite vigorously, but if it were allowed because he had unique direct knowledge of the issues, they would probably advise him to settle, because they would correctly assess that he’d be a loose cannon on the stand and would damage their case significantly. That’s why the Marrick & Arnold case was probably settled so quickly — any evidence such as phone records showing frequent phone calls from Miscavige or his “communicator” could be enough to force him to testify, at which point he’d be toast.

It is unclear based solely on the complaint that there’s enough reason that Miscavige will be forced to appear in the Luis Garcia case, though it is eminently possible that they have something up their sleeve that will result in the court compelling him to appear.
