Scientology denied: Karen de la Carriere stops a takedown attempt on videos at her channel

Karen_de_la_CarriereKaren de la Carriere has been keeping us updated on a situation she’s been facing with the Church of Scientology, and now that she’s resolved it, she’s ready to go public.

Some time ago, she received notices from Scientology attorney Gary Soter that she was in some kind of violation of some sort because of videos she had posted at her YouTube. She says that she receives threat letters from Soter about once a year, and so she passed it on to her attorney without even reading it this time.

But Soter was apparently serious, and complained to YouTube, which initially took down some videos at Karen’s “SurvivingScientology” page. But as she explains, she didn’t take it lying down.

We’ll let her explain what happened next…

      I know another Scientology lawyer in Plano, TX who does the same thing; claims an office address that has no office for him because he operates out of his home.

      • Sometimes people have arrangements with rental office places. They might have a small office, someone answers their calls, and they can book a meeting room when they need one.

        On the other hand, Scientology stuff frequently uses a street address that traces to a Mailbox’R’Us type place. (Beats me how you’re supposed to serve legal papers on someone at a mailbox.)

        Karen, I do hope you saw my post about the 9th Circuit Court in The Religious Technology Center v Wollersheim 796 F. 2d 1076 (this will help Ray Jeffrey find the case) which you should use any time the cult makes a claim against you of this manner. Their lawyers are fully aware that they have no grounds based on this court decision. Present the court’s decision to youtube or any others that bring up the issue of trade secrets. You may even want to quote this case on your videos for others who may be attacked as well. Chin up and keep up the good work!

  • Wonderful video by Ms. La Carriere. Very informative. YouTube, Scientology lawyers and their latest attempt to silence critics on the Web. Pretty pathetic. Scientology really seems to be stumped by the Web, social media, etc. The Internet was the worst thing that ever happened to Scientology and David Miscavige.

      Some lawyers will take money to do anything. I know of a teen girl sued over a car wreck that was all phony. Looked up the lawyer’s cases each one he took money from the client, filed the case, and later dropped it or simply didn’t show for court and likely took the money and ran.

It certainly seems that whenever the CofS speaks out against a film a book or a website they only suceed in increasing public interest and sales.

    Gary Soter’s letter is yet another item about which the IRS has been informed. Why are Scientology’s 501(c)(3) tax exempt dollars spent on attempted censorship and harassment under the false pretense of copyright protection? OSA and Soter both know Fair Use. If not, they could certainly have called Bert Deixler for his opinion.

    This is harassment and tyranny by OSA. Soter made multiple complaints in an attempt to have YT give Karen three violations thus having her entire channel taken down.

    In context, Going Clear had not yet been released and Miscavige was obviously screaming for a head on a pike. HBO had declined to play OSA’s stupid game and so Soter sent Karen a letter and threatened to take down her YT channel.

    Karen and I had to pay our new copyright lawyer to defend against this baseless threat.

    Through YT, we inform the Church of address of service and tell them to sue us.

    Scientology OSA Legal backed down.

    Then Karen and I saw Going Clear at the Arc Light here in Hollywood. We saw Gibney’s breathtaking and devastating exercise in Fair Use snippets of Miscavige and I was blown away. I suddenly understand why the little pissant cult dictator David Miscavige wanted to destroy something. I suddenly understand why Gibney has an Oscar.

    Thanks to Going Clear, David Miscavige finally got what he had always wanted: He made it to the big screen on a global stage.

    Problem was it was not in a good way because it was truthful.

    And now another black eye for Miscavige as his attempt to destroy Karen’s YT channel is exposed.

    The Church of Scientology needs to lose its tax exemption. This will happen because David Miscavige can’t have tax exemption and is working daily to destroy it. This is because he is an SP.

    When do the fines and treble damages start? If it is illegal to misuse the Digital Millennium Copyright Act, there should be financial penalties at a minimum for its misuse, plus compensation to the victim for their legal fees.

      I’m taking the cue when Karen says her copyright lawyer told her that her case is like microscopic damage to a car. Neither worth a civil suit or expect a DA to pursue the matter in criminal court.

      But, I suspect a specific record is in place and cos will have to answer for its cumulative effect if/when a vexatious pattern is established. I’m thinking cos won’t have a lot of allies if it abuses the DMCA and threatens reform for complainants.

            It looks like the Copyright Office is responsible for administering the DMCA in the US. They might push it off on either the FTC or FCC though if mandatory penalties were implemented against those gaming the system.

        • If you look up the Wikipedia article describing what a ‘Vexatious Litigant’ is, the CofS is used as one of the examples. They really do need to be called on this behaviour, and DMCA notices would be an excellent place to start.

          If Cof$ is ‘red flagged’, then YouTube needs to get in touch with the Copyright Office. Looking at a doc on the CO web page, it looks like they administer the DMCA and, they didn’t lay out the specifics, but apparently there are some kind of penalties that DMCA abusers can be hit with.

    I love legal service by email. It makes it so much easier to post them on the internet. No messy scanning, no fixing OCR errors, just import and away you go.

    So ‘the assistant’ {intern, or my idiot brother in law} sent the email, without my knowledge or connivance. Yeah, I can believe that. NOT. The whole thing cost DLHDM 3 or 4 hours at what $400/hr? And all for not. Soter probably claimed the take down was permanent, well, it wasn’t. How does DM send an outside lawyer to the HOLE? Some one is going to pay for this, probably the whale who financed the whole thing.

    Youtube’s take down policy is a pain, I was watching some old Star Trek Voyager shows last week and now they are all gone. But at least I can understand that copyright holders eminence in such matters. The clam excerpts that Karen and used in their vids were perfectly valid fair use.

    Soter’s bluster and threats besmirch the good name of the legal profession. Too bad the Cali Bar Assoc is such a wimp, this matter screams for some investigation.

        Karen and Jeffs videos are an excellent view into the past and current state of the clampire. Who else has all those ‘in house’ vids that let us see the Great Chatterbox of $cieno land in his natural element.

    Interesting…Soter claims Karen is “…in possession of videos stolen from the Church of Scientology by your friend John Joseph, aka “Plain Old Thetan.” Mr. Joseph was under investigation by the U.S. Postal authorities in Tucson, Arizona for his thefts of videos and other documents. He died before that matter was resolved or civil action was brought against him by the Church.”

    What proof does Soter have that anything Karen has is stolen? And, “Under investigation…” does not mean anything was actually proven or stolen. $cientology is noted for claiming things were stolen that in fact were lawfully possessed by the person holding them. Why should we believe them this time??

    decided to go hiking yesterday, fly-fishing a couple of days ago
    and hanging out in the caboose with the brakemen.
    She hasn’t decided to do the whole Appalachian Trail yet – but we may persuade her.
    She IS tough and was like a mountain-goat on the steeper trails yesterday.

    Off topic: Two weeks ago an acquaintance of mine was telling a story about how he met the guy from That 70’s show in a club where Masterson was the DJ, he was showing of the selfies that he took with him, so I told him; do you know that he is a scientologist? and he was like no way, I told him google it.
    Today I saw him again he told me that he google “Masterson and scientology” and not only that the whole subject of scientology came up including the movie Going clear, since he didn’t know anything about scientology he ordered Going clear on demand on HBO, and today he told me he was surprised to learn how deep and how complicated the cult was and now he is well informed about it, he is only 23 y/o with a lot of friends, so that is one less costumer for scientology, thank you Going clear, is working!!!

    • I doubt the CofS will ever get banned outright, and it’s probably best that they don’t . Doing so, would give them an opportunity to squeal ‘censorship’ land ‘religious persecution’ like stuck pigs and perhaps even receive some (misplaced) public sympathy..

      However, every time someone (like yourself) calls their bluff and YouTube is forced to adjudicate, they will see how spurious Scientology’s takedown arguments are and the next silly complaint from the CofS will be taken less seriously.

      In fact, it’s probably best that the CofS are allowed to freely express themselves on YouTube, because then viewers can see that what critics say about them is true – for example, that their videos are content-free propaganda because they cannot talk about their own beliefs.

      It the CofS was banned, it might lead viewers to think that there is something in what they say (otherwise, why should they be banned). As it is, they are free to condemn themselves from their own mouths.

      When you compare the popularity of channels like your yours to that of Scientology it seems obvious which side is winning the argument.

When an ex says, “and then I started to look on the internet…”, then they see your videos, Tony’s blog, Mike Rinder’s blog, Tory’s vids….and they find out more about what’s going on inside their church than Scientology ever let on.

      The Cult has gone out of their way to maliciously harm me, even with blood on their hands on the death of my son Alexander Jentzsch. Imagine serving a CULT for 35 years only to have them manipulate your only child against you and then let him die off from enforced disconnection.
      Tony Ortega gave me more comfort and solace at that time that any *Scientologist* and the CULT hid the fact that Alexander’s dead body was lying in Los Angeles morgue.

      I realize I am dealing with a Billion dollar criminal entity but they continue to underestimate Jeff and me and that is fine with us.

        As, a never-in I cannot even begin to imagine how horrible it is to spend 35 years in the cult, only to face the tragedies you’ve faced after you started speaking out. However, your story touches my heart. Especially the part about your son. He and I would be roughly the age I think….

  • Scientology Is A Dead-End Road

    Good for Karen. She is a dynamite lady !

    I finished Tony’s book. I recall several of the characters in the book having been
    at FCDC at the time. The G.O. was through a single door at the top of steel stairs
    from the 3rd to the 4th floors. There was a lot of action in and out of that door,
    and was an obvious observation that things were happening of some importance.
    Of course, us public Scientologists were being kept in the dark.
    Michael Meisner was quite serious, and didn’t seem like a happy Scientologist,
    of which there were some at that time (’73-’75) and place.
    My memory has become vague, a bit, due to trying to forget my experience there,
    although it got steadily worse over the years.
    I recall Gerald Wolfe and Cindy Raymond also, all serious folks.

    Scientology would have done much better as a simple school depending on results.
    It probably would still have failed, as few could do this complex (excessively) subject well.

    Today we have more advanced ways to change your subconscious content.
    The same applies to regaining spiritual abilities.

    Mr. Hubbard was never a sane man, and through Ego Mania and PR and Greed
    took over many trusting beings, all of the time hoping to resolve his own case,
    but studiously avoided any opportunity to do so.
    In the end he failed to resolve things to the extent that I can only conclude he was EVIL,
    and over recent years I had some comms with that being, and my general impression
    is that he is still avoiding any real resolution. These came from three sources, and more
    if you count the past.
    From two persons with long memory, I was told he was an Implanter himself originally.
    Calling himself “Source” was the ultimate megalomania.

    Unfortunately the believers are still believing.

    All religions as practiced today are CULTS.
    True spiritual practice has nothing to do with religion.

    Karen, you are absolutely right that Soter has no business writing directly to you and that he must confer with your counsel and that this is a violation of professional ethics. You have grounds to file a complaint with the California (or whichever state) Bar Association.

    I am a retired legal secretary. You have what rights you TAKE! Bust this bastard. Complain formally to the bar association.
